The John Beck free and clear system along with Mentoring of America is a scan and would like help to get my money back. They promised all kinds of good things that have not even come close to being true. There is never any land to buy on the landbank and the coach does not really know what he is talking about.

I ask him specific questions and he always responds the same way "That is a good question every county is different so you are going to have to research that." I have had five sessions of my ten and I am feed up with all of the promises. If there is anyone who can help me get my money back I would greatly appreciate the help.

Give me the dollar amount you paid. I want to add your refund price to my growing "Mentoring of America refund revenge tally" as yet another victory against these frauds. As of January 10, 2007 the Utah Division of Consumer Protection ("Division") and Mentoring of America, LLC, John Beck Amazing Profits, LLC and Jeff Paul ("Defendants") stipulated and agreed to the following:
1. Defendants shall pay a fine in the amount of $25,000.00 to the Division;
2. Defendants shall comply with the notice provisions relating to the three day right to cancel as required by law. Additionally, the Defendants shall clearly disclose the products and/or services represented in their sales presentations as well as the identity of the entity that will be providing these services;
3. Defendants shall work with the Division in resolving consumer complaints;
4. the Defendant has provided information and documents required in order to complete its application for a telemarketing permit;
5. Upon execution of this Stipulation, the Division shall issue a telemarketing permit to Mentoring of America;
6. Defendants shall comply with all of the requirements of the Utah Consumer Sales Practices Act, the Utah Telephone Fraud Prevention Act, and all other laws and rules administered by the Division;
7. The Settlement Agreement entered into between Mentoring of America and the Division shall remain in full force and effect except as modified by this Stipulation.

Make sure you have a tape recorder running and tape record the conversation when you call this Karen Johnson at the above number I posted. You want to catch her intimidation and lies on tape so that you can hand this over to the Utah investigator if she refuses to give you a refund and honor your new 90 day right to cancel per the Utah Telephone Fraud Prevention Act.

The number is to Family TV Products LLC's customer service department. This is Mentoring of America's parent company. They are an infomercial company who sell a ton of this type of garbage via infomercials. Don't select any of the voice prompts when you dial the number I gave you. Just stay on the phone and you will be connected with a customer service rep. Once they answer, you have to ask to be transfered directly to Karen Johnson. If they act like they don't know who she is, say that you know for a fact that she works there, and that you must speak to her and be transfered to her.

Karen is extremely rude and very very unprofessional. She will likely try to intimidate you as well as try to keep part of your refund for made up no existing fees and argue with you like she has done to the other people I have guided to their money back. I have spoken to her personally and she lies through her teeth. She's a real b***h and should be fired.

If this happens and you have the tape recorder running, you will have caught her on tape not only refusing a refund due to the fact that they failed to orally inform you of your 3 day right to cancel (which violates Utah consumer statute), but also anything else she says to you including intimidation and lies. If you take my advice and tape record this call and catch her, you can probably get her fired and Mentoring of America fined with that tape. So please make sure you get a tape recorder and tape this call. I want to bring her down for her fraudulent business practices.

Then you can send this tape to Utah investigator Ao Pauga with your complaints if she does not agree to give you a full 100% refund. That will be explained in my following steps once I hear back from you.

Here is what you need to do for your cash back:

MENTORING OF AMERICA FAILED TO INFORM YOU OF YOUR 3 DAY RIGHT TO CANCEL. THIS IS A VIOLATION:

Because Mentoring of America failed to inform you of you 3 day right to cancel, they have violated Utah Consumer Statute and the Utah Telephone Fraud Prevention Act. By not letting you know of your 3 day right to cancel, Mentoring of America has violated the Utah Telephone Fraud Prevention Act. Brandon, because they failed to tell you that you had 3 days to cancel for a full refund, by Utah statute your right to cancel will now be extended to 90 days because of that.

Since you only paid last month, this means that you are well within a new 90 window in which Mentoring of America must refund you or be in violation of the Utah Telephone Fraud Prevention act and face further fines from the Utah Division of Consumer Protection. Mentoring of America has been fined and punished by the Utah Division of Consumer Protection since Oct 2004 for violating this act as well as several other acts, not honoring the 3 day cancellation, and failing to reform it's business practices.

Here is what the Utah Telephone Fraud Prevention Act says: See section "B" especially.

13-26-5. Right of rescission -- Cancellation.
(1) (a) Except as provided in Subsections (1)(b) and (c), in addition to any right to otherwise revoke an offer, a person making a purchase from a telephone soliciting business required to be registered under this chapter may cancel the sale up to midnight of the third business day after the receipt of the merchandise or premium, whichever is later, provided the solicitor advises the purchaser of his cancellation rights under this chapter at the time any solicitation is made.
(b) If the solicitor required to be registered under this chapter fails to orally advise a purchaser of the right to cancel under this section at the time of any solicitation, the purchaser's right to cancel shall be extended to 90 days.
(c) If the solicitor required to be registered under this chapter fails to orally advise a purchaser of his true name, telephone number, and complete street address at the time of any solicitation, the purchaser may cancel the sale at any time.
(2) Sales shall be canceled by mailing a notice of cancellation to the telephone solicitor's correct street address, postage prepaid. If the telephone solicitor provided no correct street address, cancellation can be accomplished by sending a notice of cancellation to the division's offices, postage prepaid.
(3) (a) If a cancellation involves durable goods, as defined by rule, those goods shall be returned to the seller.
(b) If expendable goods are involved, the purchaser shall return any unused portion of those goods.
(c) A reasonable attempt shall be made to return goods to the solicitor's correct street address within seven days of exercising the right to cancel, providing the solicitor has provided the purchaser with the address. If the solicitor has failed to give a correct address, no return is required to qualify for a full refund of the purchase price.
(d) If the purchaser has used any portion of the services or goods purchased, the solicitor or telephone soliciting business shall receive a reasonable allowance for value given. This allowance may be deducted from any refund due the purchaser.
(e) A solicitor shall be jointly and severally liable with the telephone soliciting business for any refund amount due following the cancellation of a sale made by the solicitor.
(4) For the purposes of this section, "business day" does not include Sunday or a federal or state holiday.

MAKE A COPY OF YOUR UNSIGNED ORIGINAL ENROLLMENT CONFIRMATION PAGE:

You said that you still have the Enrollment Confirmation page they sent you asking you to sign and return back to them. Make a copy of it and don't sign it or loose it.

Now call Mentoring of America back and demand a refund. Let them know that since they failed to tell you that you had 3 days to cancel, they violated Utah Consumer Statute and the Utah Telephone Fraud Prevention Act. Tell them that you are giving them this opportunity to refund you in full, and if they refuse you will file a formal complaint with the Utah Division of Consumer Protection and with Utah investigator Mr. Ao Pauga to get your money back.

Also let Mentoring of America know that you have a bunch of other complaints on them that prove that they fradulently charge every person a totally different price for the same ten 30 minute John Beck calls based on people's credit limits or available funds (from $1,500 to $15,000). Also let them know that you have and seen a news report video of the lawsuits filed against then for fraud in Utah (see the other recent Mentoring of America complaints for a link to this news video).

Tell Mentoring of America that if they don't give you back 100% of your money, you will file your complaints and provide all of the above proof against them with various agencies. Let them know also that you still have your Enrollment Confirmation page which you have not signed, and that you will also had a copy of that over with your complaints if they don't give you a refund.

So for now, tell them all the above and see if they give you your money back that way. If they still refuse and don't give you your money back, just hang up and come back and let me know. Don't stay on the phone arguing with them. It's a waste of time and won't get you anywere because they are all trained to not give refunds. Then I will give you detailed steps on who to file your complaints with, what to mention, and what to provide etc to get your money back that way.

It was paid for on March 6, 2007I was not informed of the 3 days to cancel all they keep telling me is that as soon as I get the information package to sign the release form and fax it back asap. I have never signed the form and still have the original in my possession still blank.

Some of the promises that were given were that all of the money that I had invested would be recouped within 30-45 daysThat I would have access to the landbank so that I could purchase land at discounted prices, yet there is never any land in the dumb bank. They also stated that once I bought and sold 3 properties that I would get my money back as well.

They also keep telling me that all I would have to do is purchase land at tax auctions and they would be mine to resell for a profit. What they did not tell me in this interview that Texas is a redemption deed state and the waiting period is 6 mos. to 2 years. So I would not own the property if I was to purchase it.

They also stated that within 3 months that I would make about 15,000. They initially wanted 6500 bucks but I didn't have that much so they said they have a scholarship program for people like me and all I would have to pay would be the 4360. If there is anything else you need to know Anonymus please let me know. Also from reading some of your other posts..I have done the following.

I have contacted my bank because I used a check to pay for the program and they are in the process of getting paperwork together for me to fill out and sign. I look forward to your help and letting others know what a SCAM this company really is.

If you want to see where Mentoring of America hires it's fake non professional coaches, go Google "Mentoring of America General Help Wanted."

You will see Mentoring of America's local Utah newspaper job ads they place in local Utah papers like the Utah Daily Herald come right up. Read some of the ads. Some are in video. Some of the ads are offering jobs as coaches on real estate over the phone and say that no experience is necessary. These are just bums hired off the streets with no experience who simply read you a script and get paid a low wage per session. Iditos who have never done the very techniques and program they teach you. This while you paid the company thousands. Their profit margin is huge.

This is why your coach knows nothing and why they are always in a hurry to finish with you and get to their next call. This is why he's telling you to go research yourself for the answers.

Their sales people who convinced you to buy this are commission driven. The more they can get you to pay, the more their sales commission will be. This is the root of their reason for lying and giving you fake and false BS statements to get you to buy, as well as price you based on your available credit line.

I first need to know more about your situation in order to be able to better assist you and tell you what you need to do. Please answer me the following questions:


1. How long ago did you pay for this garbage over the telephone? Give me a date.

2. At the time you were solicited by the person who convinced you to buy this garbge at $4,360 over the telephone, were you ever informed by Mentoring of America of your 3 day right to cancel for a full refund? Did Mentoring of America make it perfectly clear to you over the telephone that you have 3 days starting the day you get your coaching CD's in the mail to be able to call Mentoring of America back, cancel the program, and get a full refund of your $4,360? Yes or No?

4. If yes to question #2, did you make an attempt to cancel the program for a refund within the specified time to no avail? If yes, explain.

5. Please give me any and all fake promises, statements, fake money back guarantees, lies, and false and deceptive statements you were given by Mentoring of America to get you to buy at $4,360 over the telephone. Things like them telling you that you will make X ammount of dollars in X amount of days guaranteed with the program, money back guarantee if you fail, ect.

One comment the reason the "coach" doesn't know anything is because the "coach" knows nothing about real estate. MOA hires these "coaches" directly from the local Mcdonalds or Wendys. You would be lucky if your "coach" even has a highschool education.
