Johnny Loyola ,First Knight Buidling And Design took over $60,000 for interior home renovation, has failed to work since 10/2006 and has left the house with several safety,fire hazrds ,exposed, incomplete and substandard craftsmanship. Pound Ridge New York

Synopsis of complaint:
Homeowners / consumers, signed a contract with John Loyola, vendor, on 01/26/2006 for a complete renovation of their home to be completed on or before 03/31/2006 for the price of $45,000.00 and an additional $19,820.50 for items mutually and verbally agreed upon. Please see attached copy of said contract.

As of this date the work has not been completed and the vendor has refused to show up to work, since 10/15/2006. Vendor is stating that he has a lack of funds for the project. Vendor has been given $41,000.00 of the contracted price plus an additional $19,820.50 for items that have not been produced, minus $5,000.00 for windows for a total of $14,820.50, as of 01/31/2007.

Vendor is now refusing to make any monetary restitution and has not worked in over 9 months. The home has been left with potential safety and health hazards. In addition, this has caused considerable related emotional, financial, and interpersonal stress and damages.

Consumers are seeking a full refund of $60,820.50 for breech of contract, to repair damages, to remove debris that vendor has left on the property, restitution for vendor representing himself falsely as a licensed contractor in Putnam County License # PC2442-A, for room and board for the eight week period that the family moved out of the home, and to pay for materials and labor for another vendor to complete the job.

1/2 bath located on 1st floor
Demolition completion
- Framing and drywall
- Full electrical upgrade
- Full insulation
- Plumbing completed
- Installation of vanity, toilet, and cabinet
- Decorative painting and finishing trim
- Tile floor installation
- New closet door installed

Kitchen located on 1st floor
- Demolition completion
- Framing and drywall
- Full electrical upgrade
- Full insulation
- Plumbing completed
- Installation of cabinetry (paid for separately)
- Installation of counter top (paid for separately)
- Installation of wood floor throughout eat-in-kitchen
- Installation of new appliances that were purchased separately from vendor
- Decorative painting and finishing trim
- Installation of counter top backsplash
- Nook storage bench to be built

Living Room located on 1st floor
- Drywall completed
- Full electrical upgrade
- Installation of carpeting
- New closet door installed
- Built-in shelving replaced
- Decorative painting and finishing trim
- Vent cover replacement

Entry located on the 1st floor
- Front door replaced with 1 side light closed off to outside
- New closet finished and door installed
- Drywall completed
- Full electrical upgrade
- Full insulation
- Tile floor to be repaired due to damage caused by vendors employees
- Decorative painting and finishing trim
- Staircase to be replaced or repaired and finished

Reading room located on 2nd floor
- Repainted due to vendors substandard workmanship (admitted by vendor, to be done at a later date)
- Finishing trim completed
- 3-way switch to be repaired *due to wrong installation by vendor (admitted by vendor, to be done at a later date)

Hall located on 2nd floor
- Finishing trim to be repaired due to substandard workmanship (admitted by vendor, to be done at a later date)
- 3-way switch to be repaired (* see above note)

Full Bath located on 2nd floor
- Tile work to be completed and repaired
- Drywall completed
- Full electrical upgrade
- Full insulation
- Plumbing completed
- Decorative painting and finishing trim
- Installation of vanity and cabinet
- Installation of new closet door

Children's Bedrooms located on 2nd floor
- Installation of new closet doors
- Full electrical upgrade

Master Bedroom located on 2nd floor
- Decorative painting touch ups and finishing trim completed
- Carpeting re-installed due to substandard workmanship and wrong carpeting installed (admitted by vendor, to be done at a later date)

Master Bath located in Master Bedroom on 2nd floor
- Tile work is substandard workmanship and will need to be re-grouted
- Caulk line was done incorrectly and needs to be redone (admitted by vendor)
- Ceiling repainted due to wrong paint applied for a bathroom and decorative paint redone due to substandard workmanship (admitted by vendor and was given replacement paint to be applied by consumer)

Amount owed to consumers for supplies not furnished by the vendor $24,634.11

This case was filed after all the major work was completed.  The only thing left to do was install the kitchen.  There were no problems with the wiring, plumbing or structure.  Everything was done according to code, and was previously inspected by the own inspectors.  The only problem was that the 4 year old Contractor's license had expired one month before the job was started and the contractor told the owner of this fact verbally.



This case was finally settled in the Kent town Court, 25 Sybil's Crossing, Kent Lakes, New York 10512.



Due to the financial problems caused by the construction cost which was legally in excess of the agreed amount due to the various changes in design after the contract was entered by the parties, the company is now in insolvency and facing bankruptcy. The contractor suffered approximately $29,000 dollars in supplies and made no money for a project that lasted over 11 months.
