Jomashop Sold me a defective Montblanc Pix Black Rollerball

I bought a Montblanc PIX Black Rollerball from Jomashop ($179) for my wife for our Anniversary. She used the pen for ONE DAY at work and the cap kept falling off making the pen largely unusable (it would fling across the table when she tried to use it). I returned the pen explaining it was defective with a loose cap. Jomashop returned it to me stating "Unable to accept return as the pen was not sent back in the condition in which it was sold to you. Pictures available upon request." I called them immediately and asked what they meant. They said the pen had "scratches on the barrel" and could not be returned and there was no warranty or repair they offered. The "scratches" are from my wife trying to push the cap down hard to get it to stay on. The manager I spoke to (Saith) said, "those aren't scratches from the pen falling off." So back and forth we went. I lost. They offered no remedy despite selling me a $179 defective pen. The scratches are so minute you have to hold it just right in the light to see them....and IT'S A DEFECTIVE PRODUCT nonetheless. My wife had it in her hands for one day. 

Do not buy a pen from this company. You will get what you get; defective or not.
