Back in november of 09, I started searching for a quality male and female german shepherd pair for breeding.  I found a female in Alberta (Howlin Good Times- great experience with them) and purchased on nov.18th, 09.

I found a ckc registered kennel in Ontario, Hillsview Kennels, that had a very desirable breeding (the bait) take place with a famous stud dog from Europe, Navar.  I sent a $500 deposit (money order even said "navar/henny litter") for a male in early december.  Heard nothing for over a month, then in Jan '10, they send me a pic of.....my female from the navar litter.  Of course, there are no other males left, so I get nothing.  They then pull the switch and try to get me to send another $1000 for a dog from another litter, or they would send me my deposit back since  "We sell 80k worth of dogs a year, your $500 isn't that important to me"-jonathan mcneill telephone conversation.

I initially said okay because I was kind of over a barrel; then checked the pedigree of the dog they were offering and quickly (within a 1/2 hour) said no thanks.  They were pushing a line-bred nightmare on me.  Now, of course, no deposit being returned.  Bottom line: I didn't get the dog I put the deposit on.

upon further examination of your rebuttal, I notice that you admit I changed my mind and wanted a male puppy.  It was actually only a few days, not weeks, and 2 full weeks before I sent the deposit, but you admit it.  and then you say there was only one female born and you gave me the option of taking her?  That makes no sense at all.  If you knew I wanted a male, you should have disappointed the person who sent a deposit after me, and explained your mistake. 


you are admitting your error in the rebuttal, but still want to keep my deposit?  Are you out of pocket any money?  I did not back out of the original deal, you broke the agreement.  You have never even provided a receipt, or any paperwork at all.  And even if it was 2 weeks later as you say that I changed my mind, why wait another 3 weeks to tell me my only choice was a female ?  You should have told me when I first "changed my mind" that I couldn't get a male.


if you were on the ball and care about doing this business properly, you would have contacted me when the pups were born, but you waited 5 weeks to do so.

I contacted OPP scam/fraud unit, they say to give 2 weeks to get it back, then they will proceed with my complaint.  you have no legal grounds to keep my deposit, as there was no signed or implied agreement made that allows you to keep my deposit.


***Hillsview Kennels has threatened to get a lawyer if I "slander" them anymore.  As most people know, in print, it is called libel.  If what I am stating here is not true, have at it,  Hillsview.

that is a lie.  my initial inquiry was for  a female, then I purchased one from another breeder in alberta, 2 weeks before i sent you the deposit.  my next email to you, sent well before the deposit said specifically that i wanted a MALE sable fron the henny/navar litter, it was even on the money order I sent.  You misread the email, only looking at the subject line.

 

say what you want, I never wanted a female from you, i had already purchased one weeks earlier.  call jean at howlin good times and you can verify that I already had purchased a female before the deposit was sent, in November.

 

no matter what, you have my $500 and I have nothing!!!!  spend it well.  You have now made it impossible for me to get another dog from you, as it would be stupid to send you more money.

Mr Noble first contacted us Nov. 14 2009 and after  a  few emails put a deposit down on a female pup. then after a few weeks changed his mind to a male. The female only produced one living female puppy. Mr noble was given the option to have the female, a refund or get a puppy from another litter.

"if it turns out that we can't get a sable male from this litter, we would wait for a pup from the stryker/puska breeding.

He picked a male from another litter.

He did not contact us again until Jan 25 and 26 Now he has changed his mind again.

All deposits are non refundable and when we gave him the option of a refund he wanted a different pup.
