Jose Olivares Century 21 Hilltop Fraud, Misrepresentation, Failure to Fully Disclose Known Problems. Simi Valley , California
Simply put, Jose Olivares failed to fully disclose all known problems with a property he was selling. He claimed that because the property was a trust, he wasn't required to disclose everything... (which is incorrect.) He lied by omission, was dishonest in his representation, and then smug about it when confronted.
When confronted with this, his response was a smug "Good luck proving what I knew."
He, and his office, are very dishonest people. Jose lied about the property, claimed he didn't know anything about the extensive problems even though he and a previous buyer who failed to purchase the property had numerous lengthy discussions about the extent and severity of the issues surrounding this property.
Several signed affadavits from numerous people clearly show Jose and his seller knew all about the problems months prior to their trying to sell the property again.
His broker, Sam Rafi, originally admitted that the evidence against his realtor was extensive, but then backed him and his lies.
Jose and Sam have refused to discuss the issue, instead forcing us to take them to court, which we are currently in the process of doing. DO NOT do business with him OR Century 21 Hilltop in Simi Valley.

After extensive talks with a lawyer Century 21 Hilltop had hired, it seemed like we were working towards a fair resolution. Sadly, that was NOT the case. Century 21 has flipped back to their old position that they did nothing wrong, and won't fix the situation. They just don't care, and have no interest in being fair or acknowledging what they did.
It seems from their actions that all Sam and Jose care about is removing the negative reviews they've gotten online, but they won't do anything to rectify the situation THEY created with their dishonest practices.
This attitude is exactly why this office was sued for fraud just a few years ago.

Last week it seemed like we were going to make some progress on this matter. Sadly, it was a waste of time. Sam Rafeh refuses to acknowledge any wrongdoing of his agent in spite of the evidence to the contrary.
I tried to engage Sam in a discussion about the signed affadavits from multiple witnesses testifying that Jose, his agent, knew all about the problems he failed to disclose and that he claims he didn't know about, but Sam refused to discuss the issue.
It would seem he'd rather pretend that it never happened.
Instead, Sam has threatened to sue me for exercising my first amendment rights by posting negative reviews like this one!
This isnt the first time Century 21 Hilltop of Simi Valley has been in trouble either. Here are a few links about how this same office was sued just a few years ago regarding an alleged fraud issues:

I would NEVER use Century 21 Hilltop, or Century 21 EVER again. Hilltop Exclusive Escrow is also owned by Sam Rafeh, and as such, I wouldn't do business with them either.

The report/complaint filed here is my opinion on what's transpired. Sam and I have engaged in discussions, and I hope to put this matter to rest.
