I hired Joyful Dental Care, JOY V. POSKOZIM, DDS PC, to provide home care denture replacement service for my sick, elderly mother.  The dentist did acknowledged she received payment by check for about $3,000+, from a third party who lost my mom's dentures and owed her.

Weeks later when the doctor learned my mom passed, she claimed she sent the check back to the third party and not to my mother. When I asked the dentist to show proof that she mailed the check back, she told me she did not send it with with proof of mailing.

To this day the dentist alledges she returned the check, but still can't prove that she did so like a prudent professional would do when handling refunds by mail on behalf of their paying clients. The dentist was contacted and hired by me to provide services, not the third party, therefore, she should have refunded the check to my mother.

 This dentist has shown that she's dishonest and unethical and saw an opportunity to steal from my mother who could not speak for herself.  I'm the one who hired the dentist, therefore, I am the voice for my mother and estate.  Death does not cancel the dentist's debt that's now due to her estate.  Buyers Beware of pre-paying for dental services before you get them.

 You have a right to review my complaint and form your "opinion". I agree with you in part . The third party should have issued a check to my mom, but I guess they wanted to ensure that the dentures were replaced. The hospital did their part, they paid the dentist who confirmed she received the check.

Since the dentist admitted in writing that she received the check which was in her care, possession, she became soley responsible for it. The burden of proof soley rest with the dentist to prove that she did not cash the check, which she has failed to do, thus giving rise to grounds for my complaint.

Your report is absolute nonsense.  If the third party owed you money, they should have written the check to you and not the dentist.  As it is, you don't have any claim to that money, so I am not even sure why the dentist is talking to you. 

They certainly don't have to account for the whereabouts of the check to you.  If you believe your mom's estate is entitled to that money, you need to sue the third party and get a judgement.  Again, what they may or may not have paid to the dentist is their problem, not yours.
