Chase took my car and broke our agreement

#5Consumer Comment

Mon, November 30, 2009

As most everybody, we were behind on our car payment. We made an agreement with Nichole at Roseville Chase, we were to make the payment on the 24th and the 30th(today). I made the payment on the 24th at 9:41pm. I tried to call and give reference #, but there was no option for messages at that time of night. Usually the payment is recorded the same day, so i did not worry about any posting issues. Guess What? they came and took the car this morning at 1:00. I was able to talk to tow truck operator, very nice, we had good conversation, I showed him my payment receipt, he agreed, said 'you'll probably get your car back today'.

When I tried to call, nobody would answer at Chase this am after 8:00, which is when the driver said to call. So I left messages to get Nichole's direct line. When I finally got a call back, not from Nichole, they told me she was on the line and would call right back. Over an hour later I called back, finally got patched over to Nichole. She hit the call yelling!! I was very calm as I figured we would come to an agreement, the only thing she kept saying was that I made the payment today. Untrue. I cannot control the posting times of Moneygram. I asked her if she ever called me last week, because none of my phones showed her number. And I have never avoided her calls, in fact, made sure to answer them. She completely lied and said she called!! She didn't.

The long and the short of it, Don't Use Chase. Nichole is an absolute terror of an employee. I have however used a very understanding person there named Sharon. Unfortunately, Nichole NEVER took etiquite from Sharon. Now they won't return the car because they say I must pay them over 2000$. If I look at this logically, we made an agreement, they broke it by taking car before date/times elapsed. I think they should be on the hook for bringing it back. And we carry on from there. If you're an attorney and want to 'chase' it for me, speedsports'at'yahoo. I'd love to talk to you!

Answer from Ex-Employee

#5UPDATE EX-employee responds

Laurie,
Thank you for the information. I have actually already retained an attorney to handle my case.

I was terminated for a very flimsy reason... the real reason was because I questioned the collection tatics in our office and I did not respond well to the hostile work environment. I tried to call our local HR to complain about tatics and environment in the office and would get no response.

I tried to follow office procedure without breaking state and federal guidlines and would contantly be belittled for not being agressive enough with Chase's customers. Even when exceeding office requirements my monthly reviews would state that I was not agressive enough or that I needed to "work on my close" (i.e. "get the money today regardless of the circumstances").

Ultimately, I was terminated after returning from break... I had my cell phone in my hand... it was on silent and it lit up. My branch manager took my phone out of my hands and into her office where I found her with another manager going through my personal phone. I took my phone back from her and an arguement ensued... after that I was terminated.

Flimsy reason right?

Now I am trying to contact any Chase customer that has suffered from illegal collection practices and/or harrassment out of this office to see if they can/will corroborate my side of the story.

Question for Ex-Employee

Are you a "whistleblower?

There are laws that protect you if you attempted to report illegal practices
http://www.bsa.ca.gov/hotline/

I would file a formal complaint if you were terminated due to protesting the illegal actions of your employer

Questions from an Ex-Employee

#5UPDATE EX-employee responds

Jeff,
You must of dealt with the Chase Auto Finance in Roseville CA. I am an ex-employee from there.

Based on your posting and treatment from Chase would you be willing to talk to my attorney regarding your situation? Chase is emphatically denying any wrong doing as far as illegal collection practices (and other things) - my attorney and I are looking for anyone that has dealt with this office in particular to corroborate my story that there are illegal collection practices and harrassment in this office. (among other things.)

please let me know if it would be alright for my attorney to contact you with questions and how to do so?
