COMPLAINT
Re: State of South Carolina, County of Berkeley, Case No. 2008-CP-08-0223

For The Record:

I hereby allege improper notice with regards to court hearings, and a consequent miscarriage of Justice

It is my contention that this judge allowed a collusion of lawyers to organize against a Pro Se defendant, and escalated this miscarriage of justice by leaving the responsibility for giving any type of proper notice regarding court actions to the lawyers with cross interests to supposedly give some type of notice. It is the courts responsibility to determine that justice is being fairly served. In this case it was not.

Because of the interests of these lawyers, the notices eventually provided were inadequate, late, and inappropriate specifically to providing a just forum. Further, it is the courts responsibility to ensure the notice is properly provided to each and every party, and by delegating this responsibility to a cross interested party caused the miscarriage of Justice I allege.

I believe that the motivation for this activity was the Judges evident disdain for ProSe representation as evidenced in the roll call of December 2008.

This letter is in complaint against Judge Kristi Lea Harrington, and her collusion with Mr. Jesse Kirchner of Thurmond, Kirchner & Timbes, PA as well as Steven Smith of Smith & Koontz, PA who conspiratorily failed to provide adequate notice or communication regarding hearings at the Berekeley County Court, having previously expressed discrimination against this complainant as a Pro-Se party seeking to represent his personal interests as expressed through his solely owned Corporation.

Mr. Jesse Kirchner purports inaccurately and criminally to suggest on several occasions that he provided notice to this complainant in a timely manner regarding court dates. In fact, as a registered party to the legal actions, all notices should have been provided by the court of Kristi Lea Harrington regarding each hearing date directly to me and my corporation.

In fact, I allege that the Lawyer and the court conspired to route all communication through Jesse Kirchner who serves at cross interests to myself and my company.

I am prepared to document all dates and activities that transpired.

As such I request a complaint hearing before the SC Appellate Court in relation to the South Carolina Department of Justice, in reference to this matter with each of the parties involved in this matter.

Further, I request that the order of the Judge dismissing the motions of myself as defendant, and the granted motion of Summary Judgment and Cancellation of Lis Pendens in favor of my opponents as represented by Jesse Kirchner be stayed and set aside until the matter of these complaints be fully investigated.
