Complaint filed this day, March 18, 2010 with the FTC, California State Attorney General and BBB of San Francisco & Northern Coastal California.

On Sunday, March 14, 2010 I went to www.justanswers.com a website where you can pose a question to a lawyer and get a fairly quick response.  I posed my question and got a fast response. I went into the website and checked the radio button to select $68 (there were three choices, $24, $48 and $68, approximately) because the response was concise and fast. I was happy with the service on March 14th.

I checked my credit card statement this week and found they had posted pending transactions of $142.80 and $68 on Sunday, March 14th alone - $210.00 in one day. There is another charge of $68 on Monday March 15th. I authorized one charge of $68.00 on March 14th and no more.

I contacted justanswer.coms support division by webform , as they have no phone number on their website. They have said to contact my bank if there are any questions about the charges and they are sorry if there is any error.  

I contacted my bank and they are snail mailing me a dispute form which I should receive in 7-10 days.

I went to www.ripoffreport.com and searched on justanswers.com and there is complaint on the website about the same kind of deceptive billing practices I am having.

I have filed a complaint with the FTC and the Better Business Bureau for California and the California Attorney General's Office as well.

I want two things to happen:

1)      I want all of my money in excess of $68 promptly credited back to my account.  Since they have charged me three times in two days for a total of $278.80 I dont know how much they will have charged to my card before this issue is resolved.

2)      I want this company out of business. It is bad enough to have all the fraudulent credit card charges from deceptive business practices as it is but to hold out a company as offering legal advice from lawyers and to have this kind of scam attached to that business is beyond the pale.

I was able to understand what went wrong with the billing problems on my account because, Nick, the customer service manager, took the time to investigate my issue and stayed with it until it was settled.

This issue has been resolved to my satisfaction.

This is my response to an email from customer service in which they ran a transactional query to view all actions to my credit card since this issue started on 3/14/10. This is my response to their most recent email.
 
The second note you have for 3/15: "original authorization for $68.00" as well as "you have paid a total of $74.80" is still my concern.
 
I only authorized $68.00 as you said and I am still being charged $74.80 as you also said.
 
Also you said:  " It appears that you took advantage of a special offer..." the special offer as stated on the website, when I chose $68.00 (out of $24.00, $48.00 and $68.00 choices available), offered that JustAnswer would add a 10% matching bonus to the amount I selected to be paid to the lawyer, Tina G., who attempted to answered my question. 
 
So the way the website reads the matching bonus is paid by JustAnswers to the attorney, not me, otherwise how can there be anything to match with my payment of $68.00?
 
Lastly, I followed the advice of Tina G., a lawyer on JustAnswer.com. My question was "What kind of attorney do I need to get a health care power of attorney and living will done?"
 
Since I have started to have seizures this is of concern to me in the event it happens again and I am unable to make day to day decisions temporarily, which happened after the last seizure.
 
She suggested I contact the State Bar for referrals to a lawyer or firm that specializes in Family Law and also to get a dog (provided by some social services agencies) trained to alert me at night if I have a seizure.
 
I followed Tina G.'s advice and contacted the MD State Bar by phone for a referral. They said: "Family Law handles divorce, separation, adoption, custody issues for a family. "
 
The state bar also said: "Your issue is personal and comes under the Wills and Trusts area that handles medical directives, living wills, medial and financial power of attorney and health care proxies. "
 
So the answer I received from Tina G. was actually incorrect.
 
I am not looking to have my original $68.00 refunded because my authorization for payment did not require the information I got be correct and I would not have known if it was correct or not since I am not a lawyer.
 
I relied on the expertise of the lawyer answering my question and, since the advice was incorrect, I am just glad I suffered no problems as a result.
 
Tina G. did point me in the right direction (the State Bar). The state bar cannot, as they told me when I called, favor one attorney over another by referrals to specific attorneys. They directed me to the state bar  website, where attorneys can advertise their services by area of practice.  
 
At the state bar website, I was able to choose an attorney by practice area and found health care power of attorney as a sub-area under Wills, Trusts and Estates.
 
Also I have not been able to locate any MD State Social Services agency that offers a service where a dog can be used in the home for health-related emergencies.
 
Maybe some other state provides this service.
 

So I feel I am still due the $6.80 (10% of $68.00 bonus, because that was to be paid by JustAnswer, not me). I should be paying $68.00 as authorized, not $74.80 as charged.
 
I appreciate that JustAnswer continues to work with me on this matter.
