Complaint Review: K-mart

K-mart bought a rifle from them, in 2005 and 2006 a cop came and said it was reported stolen so they took it from us. ripoff Waterville Maine

I will start by telling you I bought a 10-22 rifle from K-mart may 30 2005 for my husband and jan 19 2006 we had a cop come to our house and asked for the gun because it had been reported stolen 10 years ago in new york. So we let the cops have the gun. and so we now have no gun.

I have contacted k-mart and talked with a lady named rena and she told me that she would have to talk to a man named mark and she said he would get back to me but he didnt. So then I called the next week and got the same lady and i told her that all I wanted was my refund and they could have the gun when the ATF in Bangor maine got done with it she said we don't have any use for it and I said I don't want it back if it is stolen all I want is my refund.

She said someone would get back to me again and it didn't happen so I called the next week and I got the same lady again and she said wait I will put you to someone else. So this mark got on the phone from k-mart and I said to him all I want is a refund and when the ATF is done with it you can have it he said we don't take fire arms back. I said I don't want it either. He said we don't give refunds on guns either. And he also said it was not stolen. I said if it wasn't stolen then why did the madison and skowhegan police and Mr. Bristow from skowhegan come to my house and we can't have it back until it is cleared from the papers that it says it was stolen 10 years ago.

I told the police I don't want a stolen gun in my house. All I want is my 250.00 dollars back. But K-mart doesn't think that they have to give me any money back on it. The detective Mr.Bristow said I should talk to a lawyer and I did but he said he needed 1000.00 down and I don't have that kind of money to give out.

Can you tell me what to do because k-mart isnt going to give me back my refund? And I dont knew if or when they will be done with this gun and I dont want the gun because I am afraid that a year from now the cops will come to my house to say it is stolen again.

Odd

You bought a 10 year old "new" rifle at K-Mart? I find that hard to believe. If it came with all the correct materials and in a box, you should have been able to tell, if it was new or not, just by the materials. I'd contact the ATF directly and if they don't give you a straight answer, contact your US Congress rep. or senator. I suspect K-Mart could be in some trouble, if what you say is true. Stay away from that attorney. He sounds like a crook. I'll bet a local newspaper or TV station would love this story, if true. Let K-mart explain how they came into posession of a 10 year old stolen rifle.
