  • On March 14, 2014 the Energy Trust of Oregon removed their "Trade Ally" status and canceled six of their projects after receiving documentation about their business practices. 
  • As of the end of March their are outstanding labor claims for unpaid wages against Kamana O Kala, LLC in two of the three states they do business in. (Oregon & Louisiana) 
  • Kamana O Kala, LLC management and several senior staff are violating previous employment agreements by pursuing customers of Lite Solar, LLC.
  • Kamana O Kala LLC has abandoned three leased properties in two different states accumulating over $50,000 in unpaid back rent.
  • Kamana O Kala LLC has installed panels that belong to Lite Solar & Totalis Energy on at least three different projects without the authorization from the owner of the panels.
  • In January of 2014 a lawsuit was filed against Kamana O Kala, LLC regarding issues including the unauthorized storage of Lite Solar/Totalis equipment and solar panel assets is pending and any conversion of these assets could further the parties involved under extreme scrutiny the permissions associated with the transfer of these assets.

 

Bottom line for those considering new business with Kamana O Kala LLC is caution and prior investigation of the facts and exposure.

Regarding:       Summary to date of Kamana O Kala, LLC Known Actions

 

The following is a summary of the actions by Kamana O Kala, LLC that have been uncovered during investigations to support legal actions taken and/or lay the foundation for future dealings with them.

 

  1. On March 14, 2014 the Energy Trust of Oregon removed their "Trade Ally" status and canceled six of their projects after receiving documentation about their business practices. (The Email from David McCleland, ETO Solar Program Manager is available upon request from kellyrupp@lawyer.com)

  2. As of the end of March there are outstanding labor claims for unpaid wages against Kamana O Kala, LLC in two of the three states they do business in. (Copies of filings have been provided by former employees in Oregon & Louisiana. Online verifications will be available upon decisions by the Labor Boards.)

  3. Kamana O Kala, LLC management and several senior staff are violating previous employment agreements by pursuing customers of Lite Solar, LLC as evidenced in a UCC Filing by Craft3 for project funding. The UCC filing includes contracts with 3 Lite Solar customers. (Copies of the UCC filing, Pat Schellerup Executive Employment Contract, Letter to Kamana O Kala employees, and pre-existing customer contracts are available upon request from kellyrupp@lawyer.com.)

  4. Kamana O Kala, LLC submitted documentation to Craft3 to support financing for a project with Reed College as evidenced by the UCC filing in Attachment 2, however, Reed College claims that they did not execute a contract with Kamana O Kala  which raises the question of who signed the contract on behalf of Kamana and  Reed College for the Craft3 funding? (Copies of the Reed College email are available upon request from kellyrupp@lawyer.com)

  5. Kamana O Kala LLC has abandoned three leased properties in two different states accumulating over $50,000 in unpaid back rent. (Addresses = 2517 Mailwell, Milwaukie, Oregon – 14025 Airport Way, Portland, Oregon, in lake Charles , Baton Rouge, LA.)

  6. Kamana O Kala LLC has installed panels that belong to Lite Solar & Totalis Energy on at least three different projects without the authorization from the owner of the panels. (Cascade Christian High School, Medford Oregon, Spot Properties on 2929 MLK Blvd, Portland, Oregon, and Waianae, Hawaii.)

  7. In January of 2014 a lawsuit was filed against Kamana O Kala, LLC regarding issues including the unauthorized storage of Lite Solar/Totalis equipment, and solar panel assets is pending.  (Copies of the lawsuit are available from kellyrupp@lawyer.com upon request.)

 

There are a list of other issues and activities that are currently being researched to gather documentation, declarations and affidavits so that those issues can also be made public.  Any business or party seeking to do business with Kamana O Kala should do their own duedilligence.
