On Saturday 05 April 2014, my husband and I decided to do some research on cars. We were not ready to buy yet because we are closing on a house and didn't want the stress on our credit. We visited Toyota to look at a Prius since our main goal was to cut costs in our lives.

We worked with Jason Koellicker, who of course was very nice and the typical salesman. By the end of our test drive we told him we liked it but wanted to wait. Of course he insisted that we at least get an idea of where our numbers would be at when we were ready to finance.

The numbers came back and were too high for our budget so we told him as much. He then told us they had cars from last year that they were really motivated to sale and that he could get us a great deal. I told him financially where we needed to be and that we couldn't finance or have our credit checked for 3 more weeks since we were waiting to close on our house.

They came back with a better number and he told us he could delay checking our credit and get us in the car that day. At this time my instincts were screaming no but I didn't listen. We agreed to sign papers pending a credit check and were told they would wait. Today, 08 Apr 2014, after stressing all weekend about our choice we decided to take it back. On the phone the salesman seemed understanding and told my husband that it wasn't a problem.

When my husband arrived to drop off the car he was lectured for a solid 30 minutes for bringing it back and told that they don't usually do this. Legally they are required to within 3 business days. Finally the salesman brought my husband his keys and when my husband went out to get his car it was keyed on both sides of the car. We had recently had it repaired in an accident and it was in excellent exterior condition and no key marks. although we have no proof, this seems very shady considering the situation we just went through.

 

It's unfortunate because we planned on buying from them as soon as our house closed. Never again will I give them my business.

 We were contacted by the general manager on this issue and they are owning up to their salesman's mistake. Their salesman has been fired and they are repainting our car for free. I am happy with the quick response to our story and glad they are handling it professionally and quickly.

If you read the end of my report I do state that we have no proof. Considering the attitude from the dealership when this was brought to the attention of their manager I would consider it highly likely. Which is why I am on a public website and not in court. I'm sure they have made sure their bases are covered and could care less about one customer.

 The whole deal was shady from the beginning. I had never heard of a spot delivery and didn't like it and expressed this numerous times. I take full responsibility for going against my instincts and taking the car for the weekend. That doesn't give them the right to retaliate because we brought it back. Which by the way happened before there was even a credit check.

I am glad that you spend your free time googling laws on the internet (reliable source by the way) and worrying about problems you aren't even involved with.

My only goal is to stop this from happening to anyone else.

That without any solid proof you on your own just decided to blast a company on a Public web site.  Interesting how your title doesn't say..well we think they may have done it, or that the situation leads us to believe that they did it.  No, you stated that they DID do it and not only that they did it but did it out of spite.

As for you feeling because of the "shady" situation you just went through?  The ONLY thing shady is you buying a car keeping it for a weekend and then returning it.  Nothing you described shows that this is anything more than a very good salesman trying to sell you a car.

Oh and I am sorry to say you are wrong about the 3-Day rule as well, there is NO such law.  There are various laws that allow for cancelling of contracts entered into in situations such as Door-to-Door Sales, and Travel Packages.  But in looking specifically at UT laws(The Internet is a great thing) do not extend this "right of rescission" to car sales. 

It doesn't say that the dealer can't offer this, it just says that they are not required to do so.  Now, one other thing specifically about USED cars.  It does appear that UT may have some laws regarding the return of a USED car in very specific circumstances such as excessive repairs.  However, it does not appear to allow it in the case of "buyers remorse" which is your case.

Of course if you have the specific provision of law that allows you to return it within 3 days I hope you come back here and post it. Oh and NO I do not work for this dealer or for that matter any car dealer.
