Over a year ago, I contracted with KAT Transport to pick up a 57 chevy in Vermont and deliver it to Daytona Beach. I sent them a postal money order for a $125 deposit...

Afyer waiting for 8 weeks, KAT never transported the car and never returned my deposit... I have called them several times and they keep saying that they will mail it soon... BUT soon has not come yet after a year of waiting!

Suggestions to Help Get a Refund PLUS Interest Due

There are several ways to help KAT Transportation decide sending you a refund would be the correct way to proceed, my first suggestion would be the following:

First of all inform them that you fully intend on submitting a written complaint to the DOT (Department of Transportation). In your certified letter to KAT be very clear that your are going to write to the DOT and demand that they do a level 1 inspection on their company. This WILL get their attention and put the fear of you into them.

If the DOT goes to their company they will fully audit the company from drivers files to the drivers logs and everything between. This has shut down a lot of companies and caused thousands more companies billions in fines.

With fuel over 3.00 a gallon there is not a company around that can afford to fail a DOT audit. This will also hurt them when it comes to dealing with other customers and insurance carriers.

It will be part of their permanent record. Each time a company gets audited they get a rating. I promise you that KAT taking money from customers without rendering services has other unsavory and illegal practices and a DOT audit is the last thing they want or need.

Follow up on your threat. Give them 10 business days from the DATE of your letter to refund your funds plus another 40.00 or 50.00 in interest, that is only fair as if you were to be billed by them, they would charge you 19 to 25 % interest on a 30 day net.
I would ask (demand) for my refund in a cashiers check or money order, I would not take a company check from them as they could stop payment.

Contact the DOT in their area if they have not complied to your demand, and let them know what is going on and why you feel an audit is warranted.

In my 27 years as a truck driver and later a CEO for a large Midwest company, the DOT threat is one of the most effective ways to get what you need.
