I contracted with Kathy Lynch dba D & K Property services to manage one of my single family properties. I eventually I put two additional properties under contract. Our agreement states D & K Property Services will "...collect all rents as they become due; to render to Owner a monthly accounting of rents received and expenses paid; and to remit to Owner all income, less any sums paid out. Manager agrees to collect the rents from the tenant and to disburse funds by ordinary mail or as instructed by the Owner on or before the 10th day of the current month Later I was later informed that the check would actually be mailed on the 12th so I would go to my PO box on the 15th and would usually not find a check. Checks would usually arrive around the 18th to 20th of the month. No late fees were ever forwarded so I had to assume that all tenants paid on time. (late fees were to be split 50/50). In July I went to collect me check on the last day of the month (July 31th, 2010) and there was no check. I call Kathy Lynch and there was no answer. I sent an email, waited a few hours and called again. The phone would just disconnect.


At that point I knew I was in trouble. After thinking through the situation for a while I pulled out one of my contracts and called the number of an alternative address from the letterhead. This was the number to a Mr. Keith Dovoe. He informed me that he was taking over for his "partner" Kathy Lynch because her mother was terminal ill and that he didn't have any information on me having contracted with D & K Property Services. He gave me a long sob story about him being a real estate investor and he is so busy and that he really didn't want to take of the property management for his "partner" but he need to get everything organized and run correctly. "Kathy is a good person but she is going through some things right now" Mr. Dovoe stated that he wanted to keep my business and that I would have two months property management services free of charge. He asked that I email him the property addresses and the amount of the rents and he would call me on Monday with payment information for July rents. I didn't wait; I called him. He verified that I was indeed owned the money and that he would call me on Tuesday.


I didn't wait; I called him. He said that he would call me on Wednesday to get my bank information so that he could wire me the funds. I didn't wait, I emailed him the info a I called him. "I have been in meetings all day... I will try to get to it... I understand you need your money... blah, blah, blah. He said he would call me by he end of the work day. He didn't call. I called him a number of times trying to get some clarification on my funds. Finally I sent him and D & K Property Services an email terminating the contract and demanding rents for July, August and all deposits totaling over $6000.00. He responded to my email stating that he is doing me a favor and that If I want my money I would work with him and that my contract is with D & K Property Services and that basically if I don't play ball with his BS I can "due what I have to do". SCAM well played. Turns out that D & K Property Services in a single individual assumed named registered in the state of Texas and Mr. Devoe is free and clear. This should be criminal! Do not do business with Kathy Lynch, D & K Property Services, Heartland Services Group LLC, Devoe Investments Inc or Keith Devoe. They are thieves, scammers, liners, and give real estate investors a bad name. If you are a real estate investor, vendor renter, steer clear of these individuals and companies. They will RIP YOU OFF!

Mr. Kevin Collins;

You have selective hearing. Kathy Lynch is a friend I have known for years and is a very credible person. I was asked by Kathy Lynch if I could step in and help her with incoming calls, repair orders, etc. I agreed and stepped into this situation on good faith and intensions. You called me on a Saturday morning talking to me about how you cant reach Kathy Lynch and I have no money, etc. I told you I would need to pull your information and get back to you and I was acting as a Sit-in until Kathy returns. You were very upset and I stated that I would do everything I could to correct the issues as I learn more. I am an investor; you are an investor, so you must understand business. I am not apart of D&K Property Services, so how on earth can you drag me into all this. I am just trying to help Kathy answer calls. I went down to Houston and viewed your properties and after seeing them, you have the nerve to smear my name? The way your tenants live, must be bad karma on your part.

Kathy Lynch can be contacted by email as always. I suggest you keep me out of this and deal with her as your contract states.
