My husband I decided to sell our hm. in Rockridge, a sub division in Oakland Ca. It was a triplex, we lived in the mainhouse downstairs, & we had 2 unit's upstairs, we rented out. The payments were close to $6,000 we were behind in our payment's, rather than face forclosure we decided to sell. In all honestly we were growing marijuana in the basement, but we never hid this to our realator or the buyer. Infact we opened the doors & showed it all to everyone.
Now the house was to be purchased as is, but $30,000 was taken out for the foundation,another $5000 was taken out for a deposit on the lower unit we occupied, to be out by the said date & place was to be reasonably clean. The basement & garage we had rented for 1 month at $500.00 plus a $1000.00 deposit.
In addition we're not sure where we were going to move, so we rented out one of the unit's upstairs, we payed the deposit of $1000.00 plus six months payed in advance rent, totalling $7,600. Now we had already lost $30,000 on foundation repair on a as is purchase, we lost the $5000 because the buyer said the main unit was'nt clean enough for him. we moved-out of the up-stairs unit, & went to finish the moving & cleaning of the basement & garage.
we had 2 friends helping us out, we were tired so we went to a motel to rest-up & shower, since the new owner would,nt even let us use the bathroom facilities in the upstairs unit, there were none in the basement. Anyway, after we rested & showered, we called our 2 friends to see if they wanted something to eat, they did, so we bought a pizza & returned to the house.
When we drove-up, the place was surrounded! police were everywhere, we were scared, we simply parked our truck, got out & walked away. We called the buyers realator, our realator had his share of the cash & was already gone.He was a joke! possibly in on this scam as well?
O.k. so we called Kale Inoue, he had be-friended us & we trusted him. Kale told us that our 2 friends had been "caught in the act,cooking meth" We were shocked! we keeped on insisting to Kale that this could'nt have happened, we keeped saying it was impossible, Kale became angry, yelling at us, saying " I'm telling you they were caught cooking, in the act!!" " are you stupid or what!!"
I was in tears, we were afraid, so We asked Kale for help, we did'nt know what to do. Kale said " you 2 lay-low & I'll find out what's going on" for 2wks. Kale keeped us on the run hiding, Kale told us our friend's had "Rolled-over on us, saying it was our meth-lab, & we were having them cook"
We were blown-away, first off it was so unbelievable that our friends knew anything at all about how to "cook meth" & secondly that they would say we "forced them to cook meth" Kale used scare tacticas to keep us hiding, such as saying "Go-ahead walk into the police station & talk to them,if you don't believe me" in the end Kale told us the buyer of our hm. could sue us for devaluing of the property. Kale said I'll talk to him & see what I can do 2 days later, we sighned a paper,We did,nt know our friends were cooking meth & we would walk away & give all the money,all the deposits, the 6 months payed in advanced rent & Kale also claimed our realator had made a mistake to the tune of $12,000 we let them have that too so we would'nt be sued, by the new owner.
In the end we were left with $7000 in our pocket, we were still in shock. When our friends were released, we found-out that it was Kale that called the police, saying there was "suspicious activity going on in the basement". Our friends were busted for our marijuana, there was never a bust for a "Methlab", that was all a lie, we're now homeless.

When I went to do the final walk through inspection, I walked in on two men in the act of drying a pan or crystal meth in front of an Air Conditioner IN THE UNFINISHED BASEMENT. The two men were very skinny, dazed and sweating in the cold basement. There is no reason that one would air condition an unfinished basement. There is no reason to dry a pan of chemicals in front of an AC unit. Both suspects were charged, admitted that they were there by instruction of Arman Matthews. The charges were reduced to Possession in exchange for this information.
The seller's, Arman and Elaine, are both drug addicts with a self proclaimed long history of use/abuse/distribution. They like a variety of drugs including, but not limited to Crystal Meth, Heroin and Acid.
The facts are available to anyone that would like a copy of the police report. Crystal Meth was found on the property and in the possession of the "movers". The Alameda County Hazardous Materials team also has a report of the test results with specific concentrations of the chemicals found on the property. They matched exactly with the chemicals used to cook crystal meth.
I represented the buyer in this transaction. My duty was to see that my client is protected. The "scare tactic" I used was I informed the sellers that they are not to return to the property to "claim" their equipment, it had been confiscated by the Oakland Police. The sellers and family members of the seller have threatened myself and the buyer.
Although it is not my responsibility to talk with the sellers. They called and stopped by my office enough that I attempted to give them answers. When I read them official reports, they were in disbelief. I offered copies of the report. I also informed them that there are copies available at the Oakland Police department. Both sellers refused to visit the police station because they were strung out and unwilling to face the charges. Arman and Elaine were overly paranoid and hysterical.
Their Realtor acted as professional as could be expected given the circumstances. I would gladly conduct business with him again. The deposits forfeited by the sellers went to clean up the mess left from their drug operation.
I like to maintain a very high level of integrity and professionalism. I understand that many people are at different stages in their lives. Arman and Elaine are going through a tough period in their lives with their addictions and financial troubles. I don't mind people with extra circumstances in their lives, but if you smoke meth or shoot heroin please do not call me for your real estate needs.
