Complaint Review: Kellogg & Kimsey Inc.

To Whom it may concern,

My family has been victim of a serious crime in south Florida. This construction company was called by myself after learning one of their company representatives were on line in a local Keys forum making rude comments about myself and even advising the criminals to bring a lawsuit against us for slander. We have posted the story about the thieves online to make people aware they are criminals. We have only posted truths that can be backed up by either wittnesses or state representatives. This individual aso made fun of my family for losing both houses we owned because of these criminals.

Kellogg & Kimsey located in Sarasota Florida obviously decided to branch out of the construction business and get into the victim slandering business. Recently my family from Ohio fell victim to a few South Florida thieves who not only stole our family yacht from our business they also torched it costing us everything we owned. If thats not trauma enough Kellogg & Kimsey decided to put their two cents in which slandered my family, the victims. I spoke to David Pfeil vice president of the company who did NOT care at all. I had to beg him to look at the e mail but he just kept telling me nobody with that name or e mail worked there. Even going on to say they've had computers stolen(excuses). After getting this man to take the e mail he said he would have his I.T person look into it. One day later i get a rude and short email from this
Vice President again.

Mr. Krutko,

Issue resolved. You will not here from this address and/or user again.

funny how just the day before Mr. Vice President Pfeil was assuring me nobody worked there by that name. Instead of being concerned and saying I WILL LOOK INTO THIS IMMEDIATELY, he wasnt concerned at all.

Several state agencies have confirmed a felony was committed and thanks to the many people for your supprt through this tragedy.

After the posting from this company (which had no business getting involved in something they knew nothing about), Mr Vice President sends me this one line trashy E MAIL without even an apology. My wife and i were in tears when we read this slander posting from this company and they were even advising the thieves to sue us for slander. Im still personally not sure how exposing criminals on the internet and giving true facts is slander. But again a company in the construction business decides to put their two cents worth in slandering/free legal advise/false statements. [CONFISCAED BOAT] I just went on-line and read the entire sordid mess! That guy Robert Krutko is a piece of work. Cant some of the people and businesses he has slandered and/or libeled sue him? While it would probably be a wasted effort since he seems to have lost his boat and now his Keys home due to non-payment, at least it might get him to stop all the negativity.

Theres a big diference between confiscated and stolen but maybe this construction company of Kellogg & Kimsey have some sort of crystal ball we dont. As for the facts, if your in the construction business you should focus on the construction business, not slandering and trash talking family's that are victims of crimes.

My free advice to Kellogg & Kimsey-
Stay the hell out of something you know nothing about.

In October of 2006 I was the only bidder at an auction held at the Ocean Key House Resort in Key West Fl the resort was auctioning a 45' Corinthian passenger vessel that they said they had taken possession of for none payment of dock fees. over the next few weeks I wired the resort $71,000 and I drove to the Key's to take possession of the vessel. In November of 2006 I stayed in Islamorada in the middle Keys I had made arrangements with a marina there to do some repairs on the vessel. The broker who represented me for the purchase of the vessel Mr. Lawrence Pirrintino to whom I paid a commission of $7,100 on top of the $71,000 purchase price, drove me from Islamorada to Key West we met there with the resorts attorney Mr. Alan Eckstein at the meeting Mr. Eckstein gave me what I thought was a valid bill of sale, a letter stating the sale of the vessel was a non-judicial sale of a vessel for unpaid dockage fees sold under section 328.17 of the Florida Statutes and a copy of the application information for transferring ownership to me through the U. S. Coast Guard National Documentation Center. At the meeting Mr. Eckstein told me that the vessel had been moved from the resort in Key West to a privet dock some 20 miles north to hide the vessel from the previous owner and that the previous owner could attempt to repossess the vessel I was also told that the previous owner had been making a lot of accusations to all of the law enforcement agencies to stop the sale of the vessel this was the first time that I had any indication that there could be some problem with this transaction but by this point they had my money and I would have to make the best of the situation. Mr. Eckstein assured me that the sale was in fact legal however he suggested that I should apply for the transfer of ownership as soon as possible.
The sale of the vessel was in fact not legal and I was forced to hire an attorney my $71,000 were returned to me. This has cost me to date about $20,000 in expenses and many hour of my time in an attempt to simply purchase a vessel for my business.
