Complaint Review: Kevin Bunn

I'm an ex marine engineer, manufacturing analyst and systems developer. I'm also fairly competent with Lean manufacturing systems and flow logic.

Around 1984 and for my own manufacturing businesses I designed a highly effective manufacturing control system and worked directly with a hired programmer to develop the software. I created and input all algorithms, codes, maths and data needs such that software was extremely effective so that a young secretary managed the entire production processes, orders, raw purchases and job tickets for over 50 trades workers and machinists.

In 1989 I was asked to see if I could rectify a manufacturing chaos at a modest sized Commercial Interiors business called Schiavello Commercial Interiors (SCI) that had a low bottom line and around 17 staff making an amateur mess of all production.  The place was a nightmare of bad maths, wrong and missing components and highly inefficient production and delivery, where apparently no accurate supply had been delivered first time for over 9 years. They all used totally manual systems and photocopied order sheets.

After showing the MD what I had and what I could do, I was squeezed down to licence one operating copy [with nil source code] of my software for a pathetically small sum payable once I had proved it worked perfectly.  Within 4 months I had proved my software and was eventually paid the miniscule sum agreed.

In order to make SCI products fit within my software it was necessary to find another programmer to mofiy my software to my directions, and over the next 18 months I engaged Kevin Bunn's business called variously Bayswater Computers or Cube Systems Pty Ltd. They worked under my sole direction but were paid by SCI. I was also paid a wage by SCI for my ongoing management, planning, data development and input. 

Over the next 1.5 years I created and managed the entire costings, production and delivery schedules of dozens of manufacturing sections by myself, reduced ten week output to 3 weeks, overcame all manufacturing and listing errors and the company grew from a miserable $20mpa with a 15% botton line to over $150mpa with around a 40% bottom line.  It has since generated over $6 Billion in sales and is highly profitable.

I was paid a tiny bonus for the extra $6million profit netted in the first 6 months that equated to about $2/hour. MD's teen son meanwhile, under the rules of hedonism, was paid almost 15 times more for doing very little.

The result of this insult was that I gave notice and went my own way for the next seven years, until SCI and I made contact again and I was asked to help with another project they were trying to get systemised on pc.

Being slim on funds at the time I agreed and worked as a contractor from Jan to July 1998 to build a project SCI and Cube Systems had been apparently struggling with for 7 years without me. Cube Systems had apparently provided one of their programmers to work at SCI premises continually since I had left.

Once I had completed the project I was paid to do I departed SCI, but was given an old laptop by Kevin Bunn as I left, apparently as a thanks for all the contract work he had gained for his business via SCI. He advised he had placed a copy of my latest development on the laptop "to remind me of my great efforts", but I didn't get to look at this until 2010 due to a machine fault.

Upon proper inspection of the content I discovered the platform used was actually my own software with unauthorised adjustments. I found more than 850 illegal intrusions on my copyright software that were made by Kevin Bunn/Cube Systems Pty Ltd to the order and profit of Schiavello Commercial Interiors Group and Tony Schiavello and co.

Basically, despite a written contract between us, a billionaire called Schiavello had handsomely paid a software programmer called Kevin Bunn to steal and pirate my private copyright software and make various versions of it for SCI businesses.

Further to this, Kevin Bunn then put his own business called Cube Systems Pty Ltd (then based at Box Hill, Victroria, Australia) up for sale. Part of his sale was the stolen and modified copies of my copyright software systems.  The business was purchased by Gamut Pty Ltd of Victoria, Australia and despite my communications to them that the software they are utilising is my private copyright, they have not confirmed to me that they are not using, selling, modifying, utilising or supporting my software with their clients, which would include also the SCI Group.  This appears to be stolen software being knowingly onsold.

Kevin Bunn  has retired with $500k from the sale and earnings from my software to a beachfront at Ocean Shores in NSW and everybody else continues to knowingly use my software for their profit.  In writing I have offered to negotiate some compensation and even offered to discuss ways to pass title. I receive no communications in these regards and am apparently being ignored until I can afford to litigate while these companies and individuals continue to illegally profit through the use of stolen software.
