My son signed a student loan to get his Masters degree from Cleveland State.  His name is the same as mine except for the fact that my suffix is "Jr." and his is "III".  I do not have copies of the loan because it was not me that obtained the loan. Yet, this comapny has begun to attempt coercing me to repay this loan stating that I am responsible for the loan because I cosigned for the loan, something I did not do.  I keep getting angry phone calls saying I am late and the total amount is due.  They have submitted derogatory reports to the credit agencies resulting in a significant reduction of my credit score. I plan to file a complaint with the BBB.

If this is your son's loan, your son is supposed to be making the payments, and your son has all of the paperwork.  What does your son say about all of this when you asked him about it?  Because if he would actually just make the payments, then they wouldn't be calling you.

Because here is some information for you, the BBB is of no use to you.  If there is derogatory information on your credit you need to dispute it with the Credit Reporting Agencies.  Part of your dispute must provide proof that it is your son's loan, in the form of the paperwork that shows his name, signature, and SSN on the document and your name no where on the loan agreement.  You would supply that with a statement that you are "Jr." and he is "III". 

Now, why do you need to take care of this?  Because this is a Student Loan and because of that the companies have more power to collect.  They can actually take your tax refunds, attach any bank account you have, and possibly even garnish your wages.  So while this is something you don't want to hear, but hopefully your son didn't try to pull a "fast one" and forged your information for the loan.
