We bought a brand new 2006 Kia Optima LX. Full price with no trade in. At 5033 miles the belts & pulleys system needed repaired. At 6199 I was stranded 250 miles from home on a Sat with no Kia repair shop open. Waited 3 hrs for tow truck. Kia claims roadside asst is great. You get 100.00 per day for a total of three days only......... you do the math..hotel,food,etc.Took car to dealership 3 times for surge & stall problem which Techinal Expert says still exits. Kia says it does not and needs no repairs. And had 4+ repairs done on belts and pulleys sytem which Tech Expert says still exists. As of 15997 miles this car was in a state of disrepair & dealership says nothing is under warranty and they say these noises, etc are just characteristics of the car and won't repair. Kia has been taken to arbitration. We are waiting on decision. We can decide to decline the decision and take Kia to court. We are unsure what we will do at this point. Also the IN Attorney Generals office is reviewing the case. I have asked for them to prosicute for Lemon Law violations. YOU DONT HAVE TO GET A LAWYER to fight a Manufacturer. They will always have more money than you if you go that route. Get a consumer action handbook at www.ConsumerAction.gov. Call the BBB Auto Line and file. Call your Attorney generals office and file. Do what it takes or just be ready to take what you get. Fight for your rights. Do all communications certified mail only. Dont get on the phone. A manufacturer will try very hard to keep everything verbal. DO NOT DO IT!!!. He said, she said, never works. Get a copy of the lemon law-read it. Make them follow the law. Be polite, the people you will deal with are not the ones who built the car.

AVOID THIS CAR!!!!!!!!!

Vin # KNAGD128X65458861 has been declared a lemon buy the CBBB. It will require a branded title in the state of IN. Often, these cars are temporarily repaired and sent to auction, then end up across country on another dealers lot. A consumer may purchase and never know the car had a branded title in another state. The branded title only needs to be disclosed the first time the car is sold in IN. A carfax report is good information, but not 100% reliable information. The carfax on this Vin has left out 2 Customer invoice numbers, due to the fact the dealership could not duplicate the customers complaint(surging). Also, the fact that this car has had a roadside asst claim which left the owner stranded 250 miles from home at mileage (Aprox 6199) However on Jan 14,2008 a technical expert agreed to by both KIa Motors America and the dealership(Ray Skillman)confirmed the problem still exists. Kia refused to accept the report. This car is required to be replaced within 45 days from 3/17/2008 due to qualifing for the Indiana Lemon Law for a belts & pulleys problem which cannot be repaired after 6-7 attempts. It is a 2006 Black Kia Optima LX with Gray interior. It has aprox. 17,000 actual miles on it as of March 2008 and has had only 1 owner- purchased new from the dealer. This car will look like the deal of your life on a car lot and it may possibly be your worst nightmare. BEWARE OF THIS CAR!

I spent hours researching all the stats on consumer.org on this car and others. The car has had more than the 4 attempts made to repair and the Manufacturer will not agree to do warranty work until we sign a statement of release to retain ownership and financial responsiblity for the car after the repair. I know this is not leagal but that does not mean they wont try it and I am taking hopefully all the proper steps to prove that point. I hope this clears it up a lil better.

Obviously your car was still under factory warranty. I can't see the problem here. If a KIA certified repair shop says there is a problem, it gets fixed. It's that simple.

Also, everyone knows that KIA's are JUNK. So, if you bought a KIA without buying the extended warranty, you screwed yourself.

You also screwed yourself by screaming lemon law while you still had warranty protection.

You bought a cheap car. Nobody forced you to do that. That was your choice.

You wanted cheap, and you got cheap. I don't see the problem here.

This press release explains what Break the law, pay the fines means. Matt Gallagher & Tom Johnson or Ray Skillman were NOT involved in that case, but currently may have the opportunity to be involved in one soon in my personal opinion only. And it was the Atty Generals office that will prosecute for these matters in my personal opinion only
