My story is very similar to Misty's of St.Mary's, Georgia. The salesman for Kirby said they were opening a new store in a shopping center down the road from my house(no Kirby store there) and handed me a 2-liter of pepsi(I like Coke better).He gave me the whole demonstration of the vaccum cleaner and of coarse I signed at the dotted line.

Then I come to my senses, knowing that I cannot afford the vaccum and go to their store in Orange Park with the vaccum cleaner in the trunk of my car. I walk in and speak with John and I sign the cancellation papers and I verbally get pushed out the door. I tell him I have the vaccum in my car and am more than willing to hand it over to him, but he tells me to hang onto it and that someone will be at my house to pick it up within 10 days.

More than 2 months go by and finally a representative for Kirby shows up at my door insisting that I give him the vaccum cleaner. By then, I'm furious that they would even expect me to hand it over because in the contract it says that if no one comes within 20 days of cancellation, I do not have to give them the vaccum cleaner because they voided thier own contract.

So this man outside my door pleads with me and tells me his boss(John) is withholding his check and will not give it to him unless he gets the vaccum. He then tells me how he has a family and has to feed his kids, trying to make me feel bad for the mistake his boss made. After that, I call the financial company that Kirby operates through and talk with a representative and she agrees that I shouldn't have to give it back because it was more than 20 days with they finally showed up.

So I called John the same day right after I talked to the financial company and asked him why they were still trying to take the vaccum after I already cancelled it? About 6 days later, another person knocks on my door demanding the vaccum cleaner. Did you put 2 and 2 together?

After I spoke with John that day, within 10 days someone comes to my door to pick up the vaccum cleaner. To me, it looks like he didn't put in the cancellation till that day I talked to him(2 1/2 months later). He even tells me that he gave another manager the papers to put the cancellation in the computer, yet when I ask to have proof of the cancellation, he can't come up with anything.

So I call Abe Sharqawi, the head of this Kirby office and ask him what's going on? I tell him the same story I told you and he then says,"YOU WIN". I asked him," So you admit that you voided your own contract?" He says, "YES". He says my file will be pulled, I won't get anymore calls, etc. And today I get a call from an attorney saying I am being sued! What do you think?

First-if the "lawyer" calls again, make sure you get the name of the firm. Second, they have to file a written notice (subpoena) to you. Finally, if you have ecerything documented, you have a Kirby vacuum free and clear since they did not adhere to terms of THEIR contract.

Have fun, they don't have a case, a chance, or a clue!
