I have been having problems with lady of america since 7/29/2005. It all started with the plan I could pick. They showed me only 2 pages, that I could pick from. I chose the 3 day plan. It was the only one I could come in on. They avertised free childcare. When I started coming, I notice there were 2 guys there. They advertise it is a all women's gym. But there was 2 guys working there.

Also when I went to use the childcare, they told me it wasn't part of the plan I chose. They said you have to sign up for all 6 days. And there would be a additional charge.

I had asked for a year plan when I signed up. But they said there wasn't one for the 3 days plan. I was finding out alot of what they advertised wasn't true, or it was alittle different. I talked to the owner about men working there. They were her husband and son. Aslo I contacted NFFS, there financial company that handles the contracts. They said there was no reason to cancel the contract. It didn't matter that 2 men were there watching us. Watching us while we worked out. They would walk around the whole gym.

My next step was to contact Florida's Better Business bureau. I filled out a complaint form on 11/29/2005. They contacted the gym. The gym sent a 8 page letter back. In the letter the gym owner denies everything I complained about. He also said "You are too lazy to workout". The Better Business Bureau was satisified with what they said, and closed my case. I finally had to change my checking account. Because they would not stop taking money out. Now they have sent me to Matrix Appectance a collection agency they have. I've talked to them. A lady there named Jennie was very nice and tried to help me out. When she heard about what the letter said. She said that maybe my contract could be canceled because of name calling, harrasement. She would show her supervisors what the letter said. She called back with an update. When i tried contacting her, they wouldn't let me talk to her. They said she was in the late payment department. And that my file was sent over to the credit department. I'm not sure what else to but get a lawyer. They have false advertising and fradulant claims.

What is it about contacts that people do not undertand that they need to READ them! You chose the cheapest membership (limited to three days a week) and you singed a contract that was auto renewable. It clearly states it will renew on a month to month basis until a 30-days advanced written notice to cancel has been received. Did you send a notice to cancel? Did you agree to make 36 payments of $xxx per month or 12 payments of $xxx? (as clearly written on the contract) Because that is what you are responsible for. AND you have to give the required notice to cancel as well. It doesnt just automaticaly cancel.

Were the men in the club when you joined? That day? If so, all I can say to you is well...DUH! If not, your agreement clearly states in bold type that you have (depending on what the law is in Florida) anywhere from 3 to 5 days to cancel with out penalty (buyer's remorse) Did you see the guys and get offended by them during your first week of memebership? If you would have read your agreement you would have know you could have used that to cancel.

I own a club thru this franchise and I will tell you right now that none of our clubs participate in false advertising. People read things the way they want to read them. Right now our speical is $0 down or $19.95 per month. It is two different programs. OR not AND but people will challenge me about it.

All I can say is READ what you sign. Ask questions before you sign.
