Complaint Review: Landcar Agency

I purchased a Vehicle Maintenance contract from Landcar Insurance a division of the Larry Miller Auto Group on January 7,2010 for my brand new 2010 Toyota FJ Cruiser.  The contract stated that I was to bring my vehicle in every 4 months or 5,000 miles.  When my vehicle hit 5,000 miles I scheduled my appointment at Riverview Toyota where I purchased the contract and vehicle from.  When I took the vehicle in that Saturday, they stated that I was sold the wrong policy for my vehicle and that there would be a $25.00 charge for the maintenance.  I told them I would not pay that and that I would be cancelling this contract immediately.  I called Landcar Insurance on Monday and told them I wanted to cancel the contract due to me not being able to use it and them selling me an invalid maintenance agreement.  I was told to send a letter to them via mail and they would cancel my contract.  I was told it would take 2 - 3 weeks for this to credit back to my account.  7 weeks later it still had not credited to my account so I called Landcar to find out what was going on.  They had totally misplaced the request and she told me they would credit my account immediately.  4 days later the credit still was not showing up.  I was told the credit of $304.58 would be crediting soon.  I checked my paperwork and noticed that I originally paid $375.00 for this contract.  I then called back and let them know that I expect full refund due to the fact that I would have never purchased this plan had I known that I would not be able to use it.  I was told they are pro-rating the plan.  How can they pro-rate a plan that has never been used and is a fraudulent contract because it can never be used?  This has been a total waste of my time with Landcar and I still expect the full refund of $375.00.  Even after trying to talk common sense with the supervisor there at Landcar (why would someone purchase a contract that they cannot use?) he told me that I would not get the full refund.  I am now reporting them to the BBB and the State Attorney General's Office due to the breech of contract and the fraudulent activities and the bad business practices.  I have all documentation.  I do not want to see anyone else get ripped off by the Larry Miller Auto Group or the Landcar Insurance division of Larry Miller.
