Michael Albertine is my father and retied several years ago from Landmark.  I was unaware of this report until today.

We have been in business since 1991.  My father and I are lawyers with no bar grievances to our name. Landmark has auditors come in and check our bank accounts and files every other year.  We have never been reprimanded for our fees/costs or in general about any other facet of our business.  There were never illegal fees/costs on our statements.  That is objectively and simply a false statement.  This was a dispute of how much we were charging this customer.

Although I was not privy to the initial conversations between Michael and this customer, I was in the office and saw what transpired.  This happened a few years ago from the date off this post so I don't remeber details but I do remeber the situation because it was quite unusual.

The customer took issue with a fee for which services had already been performed.  A statement was prepsented with our fees and costs prior to closing.  Nothing was said until the customer was at the closing table.  After being told repedtedly that the fee could not be removed, the customer became irate.  Michael then matched her irateness (I am acknowledging that this was unprofessional and unacceptable).  Eventually the customer left after a long argument.

In our business, unfortunately, some people take the closing "hostage", so to speak, by not closing until we remove or reduce a fee (its not always about us and fees/costs, sometimes and buyer will do it to a seller and vice versa).  Its not right but it happens every once in a while.  I am not syaing this customer did this.  Its just an explanation of why Micahel was unwilling to remove a fee at closing.

I am writing this rebuttal in the hopes that this customer realize that Landmark is under new ownership and that I appreciate all of my customers and do not want them to leave our office unhappy.  Issues do arise and mistake sometimes are made but I always do whats right and will usually work with a customer who brings up an issue.  I invite this customer to contact our office to speak with me as I would like to make it up to you, the best I can, if you are willing to work with us one more time.
