False accusations

#2REBUTTAL Individual responds

Wed, September 20, 2006

The report above relates to the purchase of a house by the Taylor's. Without going into too much tiresome detail, the simple facts of the matter are that we did everything humanely possible to work with the Taylor's to resolve the controversy up to and including offering to buy the house back.

Although we came close to settling the matter many times every time we were on the verge of an agreement they backed out. Finally the entire mess landed in court, where the Taylor's filed numerous frivolous complaints and other pleadings.

As you might expect from very talented litigants the Taylor's after one minor procedural ruling accused the judge of unethical conduct and bias and asked that he recuse himself, which he did. When the case was finally heard by a judge from another county (whom neither I nor my partners had ever met), at trial, we reached a settlement with the Taylor's which was read into the court record. The settlement included provisions that allowed them to stay in the house for a few more months.

Of course, when the time came for them to finally vacate the home, they broke the settlement agreement and filed more frivolous court documents. Finally, they were evicted by the sherrif.

These people were not ripped off, they had their day in court and more. If anyone is interested in the details, I will gladly go over my huge file on this matter, we have nothing to hide and truly went above and beyond to try to be fair to these folks.

Although the report they have filed really is nothing more than a disjointed chronology without any explanation of what was really going on, it is obvious from the numerous times that they refer to talking to me or receiving letters from me etc that we really were working to satisfy them. If we really did back out on numerous written agreements as they say we did, any rational person would realize that when this all ended up in court, we would not have won.

Also, I would like to add that I only found this report because someone did a google search on my name and noticed it and told me about it. It is really a rip off for a website of this nature to post unfounded accusations against honest people without their knowledge for all the world to see without the accused even having a chance to reply.

Basic fairness would dictate some communication to the accused to allow them to reply or perhaps even solve the problem for the complainers. Of course after all the misrepresentations are finally found you do have a rebuttal feature which is a modicum of fairness.
