My firm selected this lawyer as a paymaster for a transaction-- we found him to be great to deal with at the outset.  However, once our payment was directed to his account, he became unavailable for 3 days time-- which is an eternity in the brisk business that we deal in.

After repeated requests from us to execute our wire, he eventually came back online and then in a terse and unprofessional manner, began manufacturing excuses and poor reasons for his lack of performance for another week.

Once we directed our counsel towards this issue, the problem was fairly easily resolved and we were able to get our funds out of his account-- albeit 9 days late.

I believe our funds somehow became encumbered due to his poor management, which is why he couldn't move them as we expected him to/requested of him.

I do not recommend this lawyer at all.  He seems to practice law in multiple areas, but specialize in none.  His word can not be believed, and he will go back on it if he so chooses.

Steer clear; you have been warned.

A person identified as "Alex" filed a mostly anonymous complaint against me and my firm. His claims are so general that it is impossible to identify which transaction he may be referring to. In addition, I have never dealt with nor contracted with a person named Alex in Chicago, IL. However, I will address his claims as best as I can.

As mentioned above, I have never dealt with anyone named Alex from Chicago. He states a payment was directed to my account. Many people assume that wire transfers happen as soon as they are initiated; however, that is not always the case. His claim that a payment was "directed" to my account does not mean that it was actually sent when he was informed it was sent. Domestic wire transfers can be completed same day if they are sent prior to the bank's cutoff time for same day wires; however, that is still not an instantaneous transfer. All wire transfers must pass through the Federal Reserve Bank, at which time they are assigned a federal tracking number and are then sent on to the receiving bank. If it is an international wire transfer, they will usually take a minimum of 1-3 banking days, if not more, depending on the banks involved.

Alex complains that I was not available for responding to requests. As mentioned above, I have never dealt with an Alex from Chicago, and so I do not know who attempted to contact me or whether I responded to a different person in the transaction. In addition, he does not state whether this 3 day period occurred over a weekend, holiday, or other time when my office would be closed. In addition, banks do not send wires over the weekend or on banking holidays. Finally, wires sent to overseas banks (particularly those in the Caribbean, Cyprus, etc.) may take 7-10 business days to post to the recipient's account due to the central bank of that country, or how many correspondent banks are involved to deliver the funds to the recipient bank.

Alex further states that I was terse and unprofessional, coming up with excuses why a wire was not sent. Without knowing which transaction Alex is claiming I was involved in so therefore being unable to address any specific claim, no funds may be released from escrow until all terms in the contract are satisfied. Escrow agreements often contain numerous triggers and requirements which must be satisfied before funds are released. Some people choose to ignore that an escrow agent is required to follow ALL of the terms of the contracts which the parties negotiate, not just sending money when one party demands it. I only release escrow funds when all of the contract requirements are met and I have all of the executed documents necessary to prove performance according to the escrow agreement. If anything is missing, no funds are released. In addition, if a situation appears to be fraudulent, or a party attempts to make unilateral changes to the terms of the agreements, I will refuse to release funds until all parties agree upon the change in writing.

I am unaware of any legal counsel being hired to demand a release of funds in any transaction which "easily resolved" the matter 9 days late. To my knowledge, this is false. 

To address Alex's last claim, under NO circumstances are any funds "encumbered" in any manner in any transaction. I have several escrow accounts, an no funds received by clients are used for any purposes other than the escrow agreements between the parties. The funds do not leave the account once deposited until they are released according to the escrow agreements and pursuant to client/recipient directions. My escrow accounts are strictly escrow accounts; they are NOT general operating accounts. Any fees I earn from escrow and paymaster services are paid to my firm to my general operating account (which never receives escrow funds) from the escrow accounts. My general operating account is at a separate bank from my escrow accounts, and therefore no commingling of funds is possible and no escrow funds are ever encumbered for any reason. Alex's statements here are false.

I cannot be more specific regarding this transaction because Alex has failed to include any specific information which would permit me to identify which transaction he may be referring to.
