My fiance and I applied at Summer Oaks Apartments for a 2 bedroom rental and with the 90.00 application fee, we also had to pay 75.00 deposit on the last 2 bedroom available. I was told 5 days later that we were denied the apartment because I had an eviction from a previous apartment community. I had no idea that this was on my record, so I requested my credit report from the agency they used and contacted my previous apartment complex that week. The eviction was over 4 years ago and since I had never applied for an apartment since then, I didn't know that I even had an eviction on my record.

Summer Oaks cashed the 90.00 check immediately, and then 3 weeks later, the 75.00 deposit fee. I was told since I lied on my application, they are entitled to my deposit. This seems very unethical to me. An apartment community is not supposed to make profits on applications. Shame on LBK Management Company for doing this and stating they don't have to prove anything to take money that isn't theirs.

As I stated above, I DID NOT KNOW I HAD AN EVICTION! Therefore, did not falsify ANYTHING! I have not rented nor applied for an apartment for several years.

I understand the application fee being kept, but the deposit should have been returned to me, or I
should have received written notice that it would not be and the reason why within 30 days, at
the very least. I was shocked to see the nerve your so called Management company had to cash
my check because you believe I lied. No proof needed, isn't that what you told me? For your
information, I left my last apartment early, because of a personal problem that I should not have to go into. The last month's rent was SUPPOSED to have been paid by my x-roommate, but wasn't. Who are you to say I am a liar?

I hope my 75.00 dollars was worth the bad press your getting from me. Because this is NOT the
only forum I have used or will use to express my disgust with LBK Management and Summer Oaks Apartments.

I'm glad I don't live there, I found a MUCH nicer apartment community that doesn't steal from
applicants.

Althougth I understand Ms. Palermo's concerns, she and her fiance signed the application agreeing to the terms of the application. It is our policy not to accept any applicants that have been evicted or are in the process of an eviction. Regardless of how long ago it took place.

Both applicants answered "no" to being evicted or sued for rent. When in fact, Ms. Palmero has an eviction on her record.

Per the Texas Apartment Association Application, which she and her fiance signed. The application fee is non-refundable. The Deposit, which may or may not be refundable of $75.00 was kept, due to a falsified application.

The last paragraph state: "If you fail to answer any question or give false information, we may reject the application, retain all application fees and deposits as liquidated damages for our time and expense, and terminate your right of occupancy. Giving false information is a serious criminal offense."

Ms. Palmero and her fiance agreed to the terms of the application and is signed by both parties.
