I purchased a brand new home from Legend Homes in 2003. Approximately 6 months after moving into my new home, I noticed large cracks in the brick (in 2004). Early in the year of 2007 (after 3 years and a few months) I discovered several large cracks throughout the interior and exterior of the residence, and cracks throughout the slab. I hired an engineer who conducted an investigation, which revealed the foundation was failing and was experiencing excessive differential movement beyond tolerance. My home has significant evidence of structural distress such as: brick cracks, drywall cracks, joint separation, cracks in the slab, broken windows, and other major distress. My house has sustained major structural damage. It was determined that Legend Homes failed to obtain soil reports of the property, failed to properly compact the soil, failed to design the proper foundation, and constructed the home in a very poor workmanship manner. I attempted to resolve this matter with Legend Homes, but they ignored my repeated complaints for months when I called, and failed to return any of my phone calls after I left messages. Also they failed to act on any of my complaints. In July 2007, I sent them a certified letter in writing, pleading with them to take appropriate action regarding my defective home that was less than 4 years old at the time. However, they failed to respond to my certified letter orally or in writing. It was apparent that Legend Homes had no intention of helping me fix any of the problems with my new defective home that they built.  I filed a complaint with the TRCC, which rendered a decision that my house had foundation problems due to excessive differential movement beyond tolerance, and was a major structural defect. Further, foundation movement, and/or poor workmanship has compromised the vapor barrier of the home, and has caused damage to windows, pipes, and the structure of the roof. Also, it has caused damage to the home that allows water to leak within the residence and outside moisture and water to enter the residence. As a result of the water leaks and intrusion, high levels of mold has developed within the residence having an adverse effect on the health and safety of me and my family living in the home. I hired an attorney and filed a law suit against Legend Homes. Upon hiring an attorney, I was advised that numerous complaints have been filed against this company regarding construction defects and poor workmanship. I was advised that other lawsuits have been filed against this company as well.  I also hired forensic experts to conduct and investigation on my home. It has been determined that the cost for all necessary repairs exceed the total value of my home.
