Lenahan Law Office ripoff and scammed Buffalo West Seneca Erie New York
Got hold of my checking account to assure payment to be received that specific day and to accept settlement offer before pursuing to court and charge fees associated with it. Same firm, different locations in New York have called and never received a call day after spoke to 2 people saying I told my bank there may be fraud activity on my account. Names of people I've spoken to:

FIVE REASONS NOT TO SEND MONEY TO LENAHAN:
1)THEY MAY NOT LEGALLY OWN OR HAVE TITLE TO THE ACCOUNTS THEY CLAIM TO BE COLLECTING.
A debt purchaser in New Orleans has sued Lenahan for accounts they bought but NEVER paid for. Your account may be in that portfolio.
2)THEY MAY BE COLLECTING ILLEGALLY IN MOST STATES BY NOT COMPLYING WITH LICENSING & BONDING REQUIREMENTS
Many states have laws requiring collection agencies to be licensed and/or bonded. Check with your state licensing to see if it is required and if Lenahan & Associates have complied. I am NOT aware of any compliance In my State of Texas, they are collecting debts ILLEGALLY!
3)THEY ARE ENGAGING IN EXTORTION(?)
ex?tor?tion n. The act or an instance of extorting. Illegal use of one's official position or powers to obtain property, funds, or patronage. An excessive or exorbitant charge. Something extorted.
4)YOU HAVE THE RIGHT TO DEMAND PROOF OF THE DEBT
Federal law, the Fair Debt Collection Practices Act (FDCPA) allows you to dispute the validity of the debt AFTER you receive a written notice. A written must be sent within five days of initial contact. You then have thirty days to dispute the validity of the debt.
5)THEY ARE ILLEGALLY POSING AS LAW ENFORCEMENT OFFICIALS, LAWYER'S AND COURT OFFICERS TO HARASS, OPPRESS AND INTIMIDATE CONSUMERS.
It is a violation of the FDCPA to misrepresent yourself in the collection of a debt. According to Attorney Danielle Lenahan, 'Officer Pompeii' (see letter) has apparently CLONED himself into three separate persons. Extortion?
This is a scam by con men and liars, desperate to steal your money. These debt collectors are not attorneys or law enforcement. They have no power and no authority.

PROTECTING YOUR MONEY
You should understand that Lenahan employees (scam artists) are well trained in the methods needed to separate you from your money.
Among methods they use to steal(?) your money are:
-Checks by Phone
Where you provide them information on banking accounts, which gives them direct access to your money, A VERY bad idea! I have received hundreds of complaints that collectors take all the money in the account. Your screams of foul mean nothing, because you gave them permission to take your money.
Solution: Contact your bank, talk with a bookkeeper, giving specific instruction to STOP payment on all drafts presented for payment. If they refuse or have a problem immediately, pull your money out. Consider closing that account. Keep records of person talked to, dates, the conversation, etc.
-Credit Card Payments
You are conned into believing you must give them a credit card number over the phone and hope, they will not steal all of your money. The problem is you have no control on how much they tell you they will take and how much they actually take.
Solution: There is a federal law that protects you from bogus credit card billing called the Fair Credit Billing Act. Use it if a debt collector swindled you. Call your credit card issuer. Tell them there was a BOGUS charge made on your account by Lenahan and you want it reversed. Get the name of person you talked with and write it down. Next, send them a certified letter stating you were the victim of a bogus charge. You will be sent a form to fill out detailing the transaction.
If Lenahan & Associates has NOT properly validated their claim to your full satisfaction, you could consider it a BOGUS charge.
Keep records of everyone you talk to; get mail receipt and copies of all letters. Record conversations where legal, or keep a diary.
If you have already sent them money make sure they cannot access your bank or credit card records again.
Take protective measures to cover your assets.
Remember these are con men, desperate to make a paycheck.

I know none of the names of the reps you have or had been contacted by in regards to this matter. I am a former employee and current bill collector. first things first.
1. Lenahan has several small offices located in the Western New York area. 20 to 30 people with the exception of the main office in Buffalo NY. Lenahan Law offices has the ability to persue you legally due to the delinquency of money that was used and not paid back due to the contractual agreement you signed when applying for your credit or loan. This also includes phone services, cable, cellular, paging etc. If you signed something service or direct loan related...you are legally responsible for it.
2. You could have recieved calls form other offices due to the fact that the client has more than one office location and files are shared throughout those offices.
3. they got a hold of your checking, or you provided it for payment of account? Bill collectors (outside of your current financial inst.) DO NOT have access to your checking information unless provided by you or (depending on your state) your spouse! This is NOT A SCAM.
4. The reason you have not been contacted is because you had told them that you had contacted your bank to report fraud. This, in turn; would cause your arranged payment to not clear your bank. This in turn will also cause delay in the process of payment until proof is provided that there is or is not fraudulant activity on your account. That requires the original paperwork from the original lender to be provided to the current owner (if different form original creditor) of your accoutn. This takes some time and deems the account uncollectable for that time. At that time the file is removed form the collectors file until more info is provided or the fraud report was deemed to be untrue. In which case it would be added back to the collection pool.
5. In reporting fraud. I hope for your sake that it is. If not, be prepared to pay top dollar on that account. Once the investigation is complete and the signature cards are supplied. If they match your signature and you do not offer your payment in full. Expect a lot of phone calls and eventually, a court date. If it is shown as fraud and it is a relative, might want to contact them and make sure they give you money for that bill they stuck you with. You would have few options at this point. The debt WILL NOT be "erased" if that is the case. if (1) pmnt on this acct was made, it is going to be nearly impossible to report fraud. It has been my experience that 90% of fraud is committed by someone in the same household. That (again) does not excuse the debt and fraud is jailable. Reporting fraud may require investigation by local authorities and again, not a situation most people want to be in if they know the individual. Either way, someone has to pay for the debt; With your SS# on the acct. the only one it is affecting is you.
6. My suggestion since the statement you made was a little vague, if you felt the company wasn't legit, you should have called the BBB. They can verify any questions of legitimacy as far as Lenahan was concerned before you canceled your settlement arrangement. You could have probably saved yourself some serious money (depending on the size of your debt.
I hope this helps, the public is improperly informed about their credit and how it works MOST of the time, don't listen to your friends and especially ATTORNEYS! unless that attorney is a debt specialist. Attorneys are notorious for PRETENDING to know how o help you. Remember. they get % or get paid by the hour! Most attorneys have a specialized field and FEW are versed in credit laws. Do yorself a huge favor. when a bill collector calls and you know you owe money on that account....take the settlement! Unless you have near perfect credit it's not worth paying the extra money when you could just settle the account and be done with it.
