Complaint Review: Lex Levinrad

Lex Levinrad lex levinrad sold me a frame house with stucco brick facade,presenting it as a concrete block house.the house was also occupied by tenants who had paid lex an $875 security deposit that I was supposed to get in the event I will have to evict said tenants.after the sale,lex has broken off all contact with me,kept the security deposit and got away with selling me a $30000 house for $100000.it is true that the house was sold"as is",but it was presented as a concrete and brick house to justify the high price,when in fact is a wooden frame house,worth a whole lot less.this could not be verified until the interior of the house was inspected,which occured after the deal was signed.Call it unethical,call it illegal,I regard it as a real estate fraud.  lex levinrad is a dishonest real estate agent.he sold me a wood frame house,pretending that it is actually a conctere block house,thus justifying the inflated price of $100000,when the real value of it is only $30000.

he also kept my $875 secutiry deposit from his tenant,who remained in the house for 60 days after the sale,causing me an additional financial loss.Rafael.Hollywood,Florida.

1. The house in question did not have stucco brick facade but was built out of brick and is clearly a brick house with one section having wood frame on the side of the house. I can provide the link to the property appraiser web site showing this. The house was inspected by the buyer and his wife and I was present with them during the inspection. 

2. The buyer and his wife viewed 3 houses that day with me. They chose this house. Both of the other houses were wood frame. They stated that they liked this house the most because of the large yard

3. The buyer was suppposed to make his mortgage payment on May 1. Security deposit of $875 was going to be paid to the buyer so I suggested that we simply take the difference and I will wire the difference. However buyer decided to pay their mortgage on May 1 anyway (without telling me). Without calling me buyer filed this report on May 5th which was a Sunday. We saw it first thing Monday morning. 

4. The house in question is certaintly not a $30,000 house. We believe buyer saw a comparable sale on zillow.com for a lot of land (with no house) for $30,000. There are many comparable sales substantially higher than what buyer paid and we have the comparable sales report to prove that. 

5. Buyer omits to mention that I sold him a house that I have personally owned as a rental property. He also omits to mention that he was given a seller financed mortgage (by me) at a very reasonable interest rate with no points, fees etc because he is not able to obtain a mortgage because of poor credit.

6. The interior of the house was not inspected after he signed. He inspected the house with his wife together with me and the tenant was there as well at the time. Only after inspecting the house and insisting that that house was the one that they wanted of the 3 houses was a contract sent to them.

7. I did not represent myself as an agent in this transaction. This was my house and I was selling it to them as a principal (and giving them a mortgage too)

8. I suggested to buyer that tenant be given a 30 day notice and we close 30 days later with the house being vacant. Buyer said no leave them in there and I will collect the rent and move in in a few months. When buyer changed his mind and told tenant that they would have to leave tenant was upset. Buyer was surprised. Not sure why - wouldn't you be upset if your landlord told you that you have to leave?

Please note that all of the above rebuttals can be backed up with copies of email correspondence back and forth between buyer and myself as well as comparable sales reports, property appraiser reports.

I have been in real estate since 2003 in South Florida. In almost 11 years of business this is the first time ever in over 10 years that anyone has ever made any kind of allegation about me. The facts above clearly illustrate this. I run an honest, ethical business practise and for anyone to suggest otherwise is harmful to my good name and reputation.
