When Life Time Fitness bought out Lifestyle in Indianapolis in mid November, I called to cancel my membership. Both Life Time and Lifestyle stated that since I cancelled after my ordinary billing date of the 20th, that I must give the full 60day notice in writing. Therefore I would be charged again in December on the 20th and have 60 days after that to continue using the gym (last month dues were paid upfront). The contract that I have on hand states that it is for a term not to exceed 36month.

The 36 months of my contract, which requires the 60day notice expired on 11/1. Lifestyle emailed me a copy of the contract which they have on file. This contract is essentially the same. However, the 36month clause is removed. The electronic signature (all were done on an electronic pad) which is on the physical copy I have is exactly the same as the one on the digital contract they emailed. It is evident that they have applied this signature to a different version of the contract. They are refusing to stop electronic funds transfer for December and refusing to credit the monthly dues which were withdrawn from my account on 11/21, 3weeks after the term of my contract expires.
