Complaint Review: Linda Diaz Academy Collection Services

After quoting the Fair Debt Collection Pracitces Act section 804 I was called a stupid *** over the phone.

I was calling on behalf of my roommate when I quoted section 804 of the FDCPA and told Linda Diaz that I could speak for my roommate and if she needed to hear from my roommate I could get her. In a sarcastic tone she said "Wow, then if you know so much you know I cannot talk to third parties" of which my reply was correct that is under section 805 subparagraph (b). I told her I would get my roommate to verify that I could speak on her behalf and she told me to "Do it then because Im not talking to you, I have nothing to say to you. Get her, where is she". When I put her on MUTE so she couldnt hear me, she muttered "Stupid ***" and when I took her off of mute and asked "did you just call me a stupid ***?" she paused then stated "yes I did" muttered a few other things then hung up on me.

What started this was when they called a neighbor a few days before pretending to be a relative desperately trying to get in contact with her which goes against section 804 subparagraph (1) not stating who they were and that it was for "identify himself, state that he is confirming or correcting location information concerning the consumer" and goes against section 807 subparagraph (10) for false representation.
