I am retired from the US Army. Twice during my career I was stationed at FT Carson Colorado I am a resident of Alaska and I never changed my Home of Record or State of Residency during my years of service. I started receiving letters form Linebarger Goggan Blair & Sampson threatning to sue me for not paying Colorado Income Tax. That really took me by suprise since I am not nor do I ever intend to be a resident of Colorado. The Soldiers Sailors Act protects members of the Armed Forces from being liable for income tax in the state they are stationed in if they are not a resident of that state. That kind of makes sense (at least to everyone but these guys). The State of Colorado also has laws protecting non-resident soldiers from state income tax. To make things even better I was overseas in Korea for half of the year they are claiming I owe the State of Colorado for. I have sent them plenty of documentation showing my State of Residency and I get nothing in return but more threats. The letters they send are very threatning and they even put part of it in bold, I guess they don't think I can read either. I am disgusted with both the State of Colorado and Linebarger for the way they take advantage of soldiers and I want them both to know I would rather pay the amount they say I owe to an attorney to fight them than to pay it. Since I have read that other military members have had problems it is now a matter of principalto fight this and I hope anyone that has a VALID complaint about them does the same.
