In February of 2006 my husband and I purchased our first home and the day after closing received a letter from the orginating lender that our loan had been sold to Litton Loan Servicing. I was informed I would receive a welcome packet with my payment coupons and dates payments are to be made and nothing from the orginating loan would change. This did not happen, three days after my supposed due date (according to LLS) I received a call informing me that I was a month late on my mortgage. We just closed on February 22, 2006. I then questioned about my payment and was told the payment amount it was higher than the amount on my loan papers. I didn't question this and wrote a check for the $$ amount and not to worry because they wouldn't report to the CRA that I was late. I knew by law they could not report for 60 days since the loan was sold. I was told I would receive a statement for the next payment and a welcome packet. This has been a repetative issue every month.

Finally in June my second mortgage was sold to another company but I was not informed until August so I sent a payment in to LLS. I then received a call from the other loan servicing company asking me where my payment was. I called LLS and spoke to a representative in their collections department who said that all the extra money was in a forebarence account in the amount of 656.98. I asked this person where all my money was going and was told that he didn't know that he was only working in the collections department and that I would have to call the Customer Service department. Another payment no Statement. Well to make things worse in August I was the victim of Identity theft. I made all the necessary reports and then called LLS to let them know that it would be possible that their payment may be returned and to please not put it back through this account and asked that they make notes to my account, the person, Jeff that I spoke with said that he would do that and not to worry about anything that someone would call me when the check came back and we could make alternative arrangements. Not only did I not get a call, the check was put through two more times not only did I get charge 99.00 by my bank but was accessed 25.00 for the first return and 30.00 for each subsequint return by LLS, When I called I was told there were no notes.

After all is said and done. I have had to start all over, close my old account in which my funds are being held until resolution of the fruadulant items, make arrangements with everyone else that was effected by this, the only ones not willing to work with me has been LLS, they call me every three days, which I told them I don't mind because this way they know that I am trying to resolve this situation, the problem every call I get I have to re-explain what is going on, notes are not being taken, I was told that I would have until September 30,2006 to get caught up with the August mortgage payment and until the September payment. I have asked them if I could send in a payment every week to catch them up and show good faith and have been told no. I asked if we could apply the forbarence money toward the payment, after all it is my money and I was told that they couldn't do that until there was atleast 1,000 in the fund, so I asked if I could mail in difference and was told no. Yesterday September 25, 2006 I called and told them that I would be able to mail my august payment off to them on Friday September 29, 2006 and then asked if we could use the forbarence account. I was told my a gal name Nicole Weaver at the customer service center that there was no forebarence account. I asked what happened to the money she said there never was any, I told her that every time I talked to Collection they told me that the funds were there. She said they were mistaken.

I then asked her regarding my status and if I was ok and if there were any intention of them to take any action and she said NO right now you are fine you are only 1 month behind. I get home and a certified letter from LLS was on my counter. It was a NOTICE OF DEFAULT AND INTENT TO ACCELERATE. Imagine my surprize.
