An elderly couple in their upper 70's had their home refinanced and Litton bought the loan from the originating mortgage company. The couple had made their payments on time for about a year until the Mrs. had a brain anurysm and was unable to make the one payment. Litton harrassed them and told them they were going to be foreclosed. This is where I step in.

I was called to refinance their home. After many attempts to contact Litton they had refused to return our calls. We also contacted Littons attorney who informed us to keep trying and if no response in week to contact them back. We found a lender who is willing to possibly take the loan and refinance. Because Litton has a foreclosure on the property we need to have Litton do a forebearence in order to strat the process.

Well, you guessed it, Litton refuses to return any of our calls. We have tried twice a day and the court hearing is on the 25th. This couple has lived in this home all their life, raised their children and have had many family dinners with their grandchildren and family. Now, because of Litton refusing to return our calls to get this couples mortgage paid off this couple many end up losing thier home. The property at the time Litton bought their mortgage was 62,000.00 and the home today is worth over 100,000.00

My loan was bought by Litton from Countrywide. All payments have been made on time through the internet (I have all printouts). Today we noticed a charge of forbearence in the amount of 275.00 and 2 payments posted for the same amount on the same day. My husband contacted litton and they said we were charged that amount because we made 2 payments early and that we were in voilation of our contract (which we never signed a contract through them) and that it was early. When my husband mentioned we only made 1 payment and it was on time they got rude and said "You were in violation of the contract and had to pay that amount" then hung up the phone on him.

#2Consumer Comment

I just read your comment about Litton, and I too, have had problems with them since our loan was transferred to them.

In November, we started having a hard time financially, so I called Litton to ask for a repayment program. I mailed the required payment (which they put in their forebearance suspense account) instead of applying it to our account. If they had applied our payment, we would not have even been 30 days late, but they filed a Notice of Default against us anyway. We were able to borrow the money to make up the difference, and we told Litton to cancel the repayment program.

Our account is escrowed voluntarily, and since we have been with Litton, it keeps going up, so I started sending them the principal and interest only pursuant to our Note, and requested they cancel the escrow account. Even though we are making our required payment, they are holding our payment until we pay the escrow amount.

In addition, there are quite a few "corporate fees" that have been added, but they won't tell me why. I am disabled, and when I called to find out why they are holding my payment, I was screamed at, told I was "incompetent, and that this is why disabled persons shouldn't be allowed to buy homes." I am in the process of preparing a Department of Corporations Complaint, but it probably won't do much good. I would love to get of Litton, but times are hard and the property values in our area are going down, I just hope I am able to refinance after the first of the year.
