Jay Evans told me he was a licensed roofing contractor and took a $2,500.00 deposit from me.

The day he was to start work I found out he was not licensed, and by law, was not allowed to contract for roofing services.

In addition, the laws only allows him to ask for a deposit of 10% of the estimated roofing cost. That amount should have been $750 - $950 - not $2,500.

When I told him I didnt want him working on my roof and asked for a refund of my money, he agreed to give it to me. It has now been 2 months, and he still has not returned our deposit.

Pursuant to your situation, I would say that the matter is considered grand theft; no materials delivered, no work performed. If you have not already done so, you may file a complaint with your local district attorney's office or with the Contractors State License Board -California. They have a web site that you can file a complaint with at www.cslb.ca.gov. If you file with the cslb they will investigate the complaint and file on you behalf with the district attorney's office who then can order restitution to you.
