I was in the market to purchase a motorcycle in August 2000 and I bid on one listed by Logan's Motorcycles on eBay. I must preface this report on why I was in the market for a motorcycle. Earlier that month, my wife passed away of ovarian cancer at the age of 32 and it was her dream for us to have a motorcycle and travel the country. I was going to buy a bike in honor of her and start a foundation to raise money for cancer research.

I found a nice Triumph that Logan's had offered on eBay and contacted the owner. We agreed to terms and I sent him $500.00 deposit to hold the bike for me until my wifes life insurance settlement came through within two weeks. Time went by and I received a letter stating my life insurace claim on my wife had been denied. On top of that, I was laid off from my job in November.

I contacted the owner of the bike shop and told him I had to regretfully back out of the deal. There was nothing ever mentioned that I would loose my $500.00 if I backed out and no contracts were ever signed stating the aforementioned. I live in Detroit and the bike shop is in Mesa, AZ so all the contact was via phone or email.

For the next few months I got the run-around about the refund of my $500.00. He said some other guy had the money who owned the bike before me. Finally, he bacame a hard a*s and refused to answer my emails and phone calls. It's ironic because he does charity events. Hmmm, wonder were that money really goes? So it cames down to that he stole my $500.00 and I am still out of work. No bike. No $500.00. No job. Aint life grand.

You found this bike on e-bay. Bids on e-bay should only be made by serious bidders who HAVE the money in hand to follow through on a sale.

You gave this person $500 to hold this bike.... basically telling him you were going to purchase this vehicle and giving him "good faith" money so that if someone else came around and wanted to buy it, he would not sell it. So what you are saying is that it does not matter if while he was waiting for you to come up with the money, which you did not have and could not be 100% sure you would have, he took the bike off the market and turned down any other possible offer for a cash sale.

Now that you have renegged on the deal you want him to just hand you the $500 back? Just because you had no signed contracts with this person does not mean you did not have a verbal contract with this person to purchase this item from them. You should not have offered if you did not have the money in hand to begin with. A person is only as good as their word, you broke your word.

I am sorry if your wife passed away but that is no reason to claim this as a rip-off. I would not have given you the deposit money back either. I hope he posted you as a "bad buyer" on e-bay as well.
