Official Complaint Filed 12/27/04

From FULL Name: Rene & Bill C
Subject: File Complaint
Complaint against?: Cat Breeder
Name of breeder?: Melanie Lowry
Breeders Cattery Name: Lollimop's Himalayans

FACTS 1: "My husband in good faith wanted to purchase me a kitty for xmas. He found lollimops and called Melanie. Melanie said she has a boy flame point for $500.00 but needed a $100.00 deposit upfront thru Paypal. My husband wanted to get me a cat, did the $100.00 deposit with OUT seeing the cat first. After talking to other breeder, he was advised NOT to purchase kitties from this breeder. On the same day my husband call Melanie to ask for the deposit back because he changed his mind. Melanie said "NO REFUNDS". She got very rude and hung up on my husband. This transaction all took place within a 8 hour period. I have read all the complaints about this breeder and I am so shocked she still is in business. I only want what is fair. I have no deposit and no kitty. Please help an honest buyer. Gratefully, Bill and Rene C"

---------------------------------------------------------FACTS 2:"Thank you so much for your response. I am so devastated about this women and the horrible things I have read about her and her partner. I recently purchased a baby boy from a local man in Anaheim, Ca who was wonderful. I went to his house saw the mother and father of my baby and I was very pleased with the care of the cats. Melanie would not let my husband come to her house, she wanted to meet half way. First RED sign. Second she wanted a $100 deposit immediately before seeing the cat or the condition of the cat. This is bad business and this women needs to be shut down. I have contacted the BBB in San Diego, the CFA and your organization. I hope that something comes out of this good. My husband is also disputing PayPal. Melanie was very hostile and rude with my husband and even hung up on him. I had my mother contact Ms. Lowery because she is a member of the CFA and I thought they could work something out. Melanie hung up on my mother as well. Please stop this women. Gratefully, Rene Carr"

---------------------------------------------------------FACTS 3:"Melanie wanted to meet in Temecula and for him to call her that same day. They never had a set place to meet, she said she was dropping off some cats in Temecula and they would meet somewhere. I am so disappointed with this whole transaction, it just keeps getting worse."

---------------------------------------------------------
FACTS 4:"FYI Melanie is already writing letters to the CFA, Better Business Bureau and PayPal and she is disputing all our claims we received a copy of her letter to the better Business Bureau. I hope what you are doing really stops her from taking advantage of good people. What we did was out of good intension to purchase a kitty but because of the things that were said caused us to cancel the transaction. The other breeder said that all her kitties are sick and have died and for us to get our money back, She even said that Melanie would not refund the deposit and that she is really desparate for money.
Thanks again "

---------------------------------------------------------FACTS 5:"she never allowed my husband to come to her home. she would only meet him 1/2 way. I don't even now if this is her correct address"...
Thanks again

---------------------------------------------------------
Melanie Lowry refuses to ignore this complaint. 2 complaints were mailed to her home

STOP! ..before you think about using the Better Business Bureau (BBB)... CLICK HERE to see how other consumers were victimized by the BBB's false or misleading information. Don't be fooled! It has been reported, when there are thousands of complaints and other investigations underway by authorities, the BBB has no choice but to finally give an UNsatisfactory rating to a BBB member business that is paying the BBB big membership fees every year. When a business is reported that is NOT a BBB member, BBB files WILL more likely show an UNsatisfactory rating, then reportedly shake down that company to become a member of the BBB. One positive thing about the BBB is, either way, if a business has an unsatisfactory rating with the BBB, you can be sure, the business is bad. But what about all those BBB member businesses that had complaints filed against them? Consumers never get to hear about them. What about the BBB advertising to the public? Is this a false and misleading perception they are giving about consumer confidence when dealing with a business? Click here to understand more of what consumers and business alike are saying about the BBB. You decide. ..Remember. The BBB membership is not earned, it's paid for!

Samantha dear If you align yourself with Zizzo

#9REBUTTAL Owner of company

Tue, April 26, 2005

I am assuming you are to stupid to read and understand what I wrote.
If you align yourself with Zizzo your credibility comes into question.
I am sure that I made it very clear what happened. You do not think that a breeder should be compensated for taking that animal off market and then losing a sale? The breeder will have to re-advertise and chances are the animal will be to old by that time to get top dollar and will have to be sold at a greatly reduced price.
You make your self sound as wacky as the wacko Zizzo, going all over the place demanding deposits back.

It is clearly stated in plain veiw on my website that deposits are non-refundable unless there is some reason that the kitten is not fit to go to it's new home, then of course it is returned. That was not the case here. He didn't have to put a deposit down, but then the animal is still availbale isn't it?
How do you know that I do not have repeat business?

I would say that fully half of my business is repeat.
Zizzo never posts all the emails that she get in support of me, that is not the way she works. She is a liar and a thief, she doesn't pay for the cats she bought, she is a breeder who has been kicked of the Cat Fancy for dispicable ways.

She kills her animals or dumps them at the kill shelter when she tires of them. She is just someone with a grudge! Why not go after her?
You should look on this website to see all the complaints made about her by others...all the complaints about me are made by her! What does that tell you? Or is that over your head too?

Questions for breeder.

#9Consumer Comment

Mon, March 14, 2005

Melanie:

I am assuming you are the breeder in the above complaint. I have some questions for you.

Are you, as a breeder and business owner, saying that you intend to keep all deposits without ever returning monies paid for your kittens? If you are in fact saying this then you have terrible business ethics.

As mentioned above, my mother and I have had many champion breed animals in our homes over the years. My mother had a kitten all the way from Belgium, Germany once. We worked through the money conversion and shipping to ensure a smooth transaction. We have both bought champion breed dogs. My mother has waited as high as six months and more for a particular pup. She prefers chosing pups before they are weaned from their mom. One she wanted and had placed a deposit on did not make it. Did our breeder take her deposit? No. She offered to either refund the deposit or let my mother choose from another litter or wait until those parents were bred again. My mother waited several months before picking out her puppy. Never once did our breeder try to pull one over on her. This is the difference between quality breeders and those that are say... morally questionable. I have no idea where you get the idea that breeders can just take people's money in any fashion they want. This is a horrid way to do business. You must not get a lot of repeat business.

We have dealt with breeders from all over and never have I heard anything like the silliness you described here. When I got Kitt, my current cat, I actually went with the intention of getting his sister. His sister was sold before I got there. The animal league showed me the brother. I was given his vet records and history, what was available. I also was given an emergency number and contact person in case there were any problems later. The contact number works because I had to call when the kitten's sugar levels got low once.

If I were in the market for a champion-bred kitten, your business would not make the list. It is not because of the initial complaint. It is solely on the basis of your response. Refusing deposits is just bad business. I am fully aware of how businesses run from the perspective of the buyer and the seller. I have six years of college in accounting and business, fifteen years keeping a business going, and an additional five years working for a large corporation in the contractor department. I had my own business for six years prior to learning I was going blind. The least you could do is give back 90 percent of the deposit, keeping 10 percent for your time and administrative costs. This, at the least, would make you sound more reputable. As it stands now, I could not recommend you as a breeder.

The TruthRosemarie Zizzo has been stalking me for almost two years now

#9REBUTTAL Individual responds

Sat, March 12, 2005

Rosemarie Zizzo has been stalking me for almost two years now. She writes these lies and posts them all over the internet on any site that will allow her to do so without checking to see if her story is true and her facts are accurate. The person writing this had nothing to do with the people that it involves, she was no there and what she is posting is third hand hear say.
This particular incident happened a few days before Christmas.

This person contacted me for a kitten pictured on my website. The kitten was already sold and clearly marked with huge bold red letters that said so. He was so insistant on having this kitten, even though I repeatedly told him that it was not only sold, but was already in it's new home. He told me he was desperate to find a kitten for his wife for Christmas because her's had just died.

He also told methat he had a deposit on a kitten and the breeder had called that morning to tell him it was sick and would not be ready in time for Christmas. I had only one kitten left, not a flame point like what he wanted but a blue eyed white that I was going to keep for myself. I felt so bad for Mr. Carr that I offered him the kitten. He immediatly insisted that I hold it for him for Christmas. I advised him that I would not tell any one about it, unless I got a specific request for that color and then he could be sold.

He asked again to have the kitten held for him. I remined him that he had not even seen the kitten and that if he gave me his email address I would send him a picture of the kitten, which I did. He called me right back insisting again that I hold the kitten.

I explained to him that I would not hold him without a deposit and that deposits are non-refundable but that if he wanted to take a chance then maybe the kitten would be here but that I couldn't promise. I asked if he was sure about this kitten and he replied that he was, but wanted to talk to his mother who used to be a cat breeder. His mother called me twice and offered all her cat breeding advice which consisted of 1 litter 18 years ago and told me repeatedly how excited they all were to get this kitten.

I explained to her that the kitten would remain available until I recieved a deposit. She said that was fine and would talk to her son. He called again ready to place a deposit to old the kitten until he could pick it up. He told me that his mom would take care of it for two days so that would be on Wed. I told him that if it helped I was going to be delivering to kittens on that day to a disabled lady in a town near him and that since he was almost two hours away that perhaps he would like to meet me there and cut his driving time in half.

He said that would be perfect and asked me to walk him thru the process of making a deposit with Paypal. I reminded him, and it is clearly stated on my website like all cat breeder websites, and dog breeder websites, that deposits are taken in good faith and are non-refundable. Did he understand? He did and placed his deposit.

Late that evening he called to tell me that his wife had changed her mind and wanted to rescue a cat from the pound, could he have his money back? I reminded him of our agreement that the deposit was non-reundable. He refused to accept this and cajoled and demanded and got abusive with me.

I saw no other way to get him off the phone other than hanging up on him and told him I was going to do just that, that I had answered him many times and the answer remained the same.

Then he asked me how long the deposit would hold the kitten for, I told him 30 days, so he asked me to hold the kitten that long and hung up. I never heard from him again and at the end of 30 days sold the kitten.

Turns out that this guy ws Rosmemaire's son, she had set me up so she could harass me some more.

Tips for Safe Buying of Cats/Dogs - My Heart Goes Out to You.

#9Consumer Comment

Wed, March 09, 2005

What happened to you is completely uncalled for and upsetting. No breeder should behave that way. In all the years my mother and I have had champion breeds and mongrels, we have never suffered the treatment you went through with your kitten.

The last champion breed animal I bought was a teacup Pom, sable colored. His breeder bent over backward for me. She has a high reputation in this area and proves herself time and time again. My little Corky was a champion breed, runt of the litter, and the last one left. He was popping up and down in his puppy playpen when I came by wanting a puppy. As always, his papers were offered for inspection, his parentage was offered for critiquing, and any information I needed was there, readily available. I lost Corky to old age a couple years ago but I can say he had a wonderful entrance into this world, a happy pampered life while here, and went out with grace to cross the Rainbow Bridge.

In light of reading so many reports about bad experiences buying animals, I wanted to add some suggestions, a list of sorts to follow. It has proved its worth for my mother and I many times over the past years. My last purchase of a kitten as a pet for my guide dog was made through the local animal league and following my own advice, it went off without a hitch. Kitt is healthy, happy, and full of energy.

1) Check Ripoffreport.com before considering a breeder or animal service.

2) Always demand access to animals, including parents, and paperwork regarding animals by way of vet reports, organizational records, and references of other customers - preferably on the parental line you are considering. Don't settle for just one reference. Get several.

3) Contact references, vet offices, and organizations to ensure the breeder is who he/she claims to be. Follow on all health problems. Ask animal organizations such as AKC and CFA and others about what you discover.

4) Locate a reputable vet and develop a working relationship with him/her and the staff. Ask for references to quality breeders. Better still, ask if any of the customers have kittens or puppies to consider for purchase.

5) Scope out vet office/hospital. Get info on emergency contact, staff hours, boarding, sanitation ratings, cleanliness of building and housing areas, and get references.

6) The day your purchase your animal, demand the registered papers and vet records on delivery. Always pick up the animal AT the breeders place of business. Never do the halfway there approach. You need to see where this animal is coming from and make sure it is safe and sanitary. If that little voice says walk away - then walk away. Get emergency information with phone number, address, name and emergency contact of the breeder.

7) When you get your new bundle of joy run, don't walk to your vet office and have a ear to tail checkup. Bring all your paperwork (vet records, lineage papers, former line problems, etc...). Make sure that new addition to your family is healthy. Follow your vet's advice on feeding, treats, grooming, and health precautions.

These little tips have worked well for my mother and I. We have had various animals all of our lives and most have lived long, healthy, happy lives. There were problems along the way with some but those problems were unavoidable. Nobody was guilty. It just happened.

If you do discover problems along the way, contact your local animal organization for ways to ensure the bad practices stop. If you cannot get answers there, contact universities in your state that have vet schools. Many staff members are more than happy to help put a bad breeder or organization out of business. They are generally fond of animals of all kinds and want nothing more than to see animals healthy, happy, and treated with respect due.

If the behavior is criminal, contact your local police, sheriff, or district attorney. Many states now have a separate governing animal police section just for such complaints. If you know of someone who is mistreating animals, please let them know. Animals that are mistreated can hurt themselves and others. Stop it before it goes any further than it has to go.

Save others the headaches you suffered by posting complaint reports here at ripoffreport.com. Information is the key.

Unless you are planning to breed your new addition, remember to control the pet population. Have your cat/dog spayed/neutered at the earliest convinience. Contrary to popular belief, animals do NOT have to go through one heat cycle to be healthy. Matter of fact, it is more healthy to have them spayed/neutered early to prevent health problems such as testicular cancer, ovarian cancer, and other similar problems. In regards to males, having them fixed early does calm down the roaming instincts. It is a safer, cost-friendly, and healthier choice to not breed a pet. Enjoy them. Don't breed.

I hope these tips help you and others to have a healthy and happy buying experience. Planning a safe buying experience leaves you time to enjoy your new family addition.

Warmest regards,
