Long Beach Acceptance REPOSESSED MY WIFE's NEW NISSAN FRONTIER BEFORE 90 DAYS & WON'T ALLOW ME TO BRING PAYMENTS CURRENT & WON'T RETURN PERSONAL POSSESSIONS RIP-OFF LOS ANGELES CALIFORNIA
MY WIFE'S ONLY CHILD WAS KILLED ON OCTOBER 19,2001. WE
HAD JUST BEEN THROUGH CHAPTER 7 THREE MONTHS BEFORE. WE
HAD FUNERAL EXPENSES AS HE WAS KILLED AT DAYTONA RACEWAY
IN FLORIDA AND HAD TO BRING THE BODY TO CALIFORNIA AND
TO WASHOUGAL, WHERE WE LIVE FOR BURIAL. IN SUMMER 2002,
MY WIFE'S CAR WAS NEEDING REPLACEMENT, AND SHE WAS
DISABLED, SO I THOUGHT THAT WE COULD AFFORD A NEW VEHICLE.
WE HAD RECEIVED AN INSURANCE CHECK FOR HER SON'S DEATH
AND SO I WENT TO TOWN & COUNTRY NISSAN IN VANCOUVER, WA
TO DISCUSS TRADING. THEY GAVE ME ONLY $1,000 FOR A 1996
NISSAN MAXIMA THAT SHE PAID OFF WITH INSURANCE MONEY.
THEN THEY CONNECTED ME WITH LONGBEACH ACCEPTANCE TO
FINANCE. THE RATE WAS HIGH, BT THEY SAID THAT I COULD
TRADE THE CAR AND GET 1/2 THE RATE AFTER OUR BANKRUPTACY
HAD BEEN 2 YEARS, WHICH WAS ONLY ONE YEAR AWAY. WE HAD
GONE TO FLORIDA TO OUR RETIREMENT HOME THAT5 WE BOUGHT
WITH THE INSURANCE MONEY, AND OUR MAIL WAS NOT FORWARDED
PROPERLY, AND OUR PHONE BILL LAPSED.
WE DIDN'T GET A PAYMENT BOOK FROM LONG BEACH, AND THE FIRST COUPLE OF PAYMENT WE HAD TO MAKE OVER THE PHONE, BECAUSE THEY WERE LATE AND THEY WERE CALLING AT MY OFFICE. THE STRESS OFALL OF TIS FINALLY GOT TO MY WFE AND SHE WENT BACK TO WASHINGTON, AND ON JNUARY 2, 2003, MY WIFE'S TRUCK WAS REPOED. MY PHONE WAS OFF AND IHA NO WAY TO CONTACT THEM.
MY WIFE HAD SENT THE MAIL FROM WASHINGTON AND IT HADN'T
ARRIVED, WHEN ALL OF THIS HAPPENED. THERE WAS NO NOTICE
OF INTENT TO REPO THE CAR AND THE PAYMENT WAS ONLY 73
DAYS LATE ON JANUARY 15, 2003, AND IT WAS TAKEN ON
01/02/03.
WHEN I GOT OUR PHONE BACKON I IMMEDIATELY
CALLED LONG BEACH WHEN I GOT MY WIFE'S MAIL SHE HAD SENT
TO ME. I TALKED TO LONG BEACH AND THE GIRL WAS SARCASTIC
TO ME AND WHEN I OFFERED TO BRING THE PAYMENTS UP TO
DATE WHEN I GOT MY 401k CHECK ON 01/24/03, SHE LAUGHED
AT ME AND TOLD ME THAT THE VEHICLE WAS AT AUCTION AND I
WOULD HAVE TO SEND HER $35,000 TODAY TO RECLAIM IT. I
ASKED HER ABOUT MY PERSONAL POSSESSIONS, A NUMBER WHICH
WERE HIGHLY PERSONAL, THINS BELONGING TO MY WIFE'S SON
AND DRAWERS FROM THE ANTIQUE DRESSER THAT I HAD BOUGHT
HER IN FLORIDA. THE GIRL SAID THAT SHE CAL ME BACK, BUT
HAS NOT, AND I MADE THE CALL OVER 10 DAYS AGO.
I INTEND TO SUE LONG BEACH FOR FAILURE TO NOTIFY OF REPOSESSION, WHERE THE CAR WAS TAKE, AND THE PROPER MANNER BY WHICH TO RECLAI THE VEHICLE. NOW ALSO CONVERSION OF MY PROPERTY.

Hi, as a car financing collector, I have some suggestions for you. I do feel bad that all this has happened to you, but there are a few things you might want to know before you proceed with legal means.
If you reside in FL or CA, be aware that you do NOT live in a mandatory cure state. A right to cure is a letter sent out notifying you that you have X number of days to bring your account current or the vehicle may be repo'd. Since you were past due, LBAC has the right to repo your vehicle without notifying you of this.
While I don't work for them and realize there are a lot of problems with this company, you should be aware that the law probably will not side with you. Also, to get your possessions back, contact the auto auction that the vehicle is at. They may be able to assist you furthur.
