I got the following letter from Lorena Ortiz' "company."
Dear Terri Galietta: Please be advised that I serve as Litigation Coordinator for 99th Floor LLC DBA Top Tradelines and WholesaleShelfCorporations.com (collectively, “99th Floor”). I am writing in reference to your false and defamatory statement posted on Tuesday, May 5, 2015 on RipOffReport.com (Report: #1227053). Please note that it is unlawful to engage of defamation of another’s character and reputation. Defamation consists of: (a) A statement that tends to injure reputation; (b) communicated to another; (c) that the speaker knew or should have known was false. Your post is injurious to the company’s reputation, as well as to the reputation of a member of its Sales Team, Lorena Ortiz and is completely false. 99th FLOOR HEREBY DEMANDS THAT YOU IMMEDIATELY REMOVE YOUR RIPOFFREPORT.COM POST AND CEASE AND DESIST FROM POSTING ANY ADDITIONAL DEFAMATORY COMMENTS ABOUT THE COMPANY AND/OR MEMBERS OF ITS SALES TEAM. Please be advised that 99th Floor reserves the right to pursue all available legal remedies, including filing a lawsuit against you should you fail to comply with this demand.
I sent them a letter asking why she is omitting the fact that the legal definition of defamation is as follows:
Defamation
Any intentional false communication, either written or spoken, that harms a person's reputation; decreases the respect, regard, or confidence in which a person is held; or induces disparaging, hostile, or disagreeable opinions or feelings against a person.
I wrote a TRUE statement. Lorena Ortiz had been asked MULTIPLE times to stop spamming me. I assumed, from the fact that I called the number listed for the "company" and it was HER.. that there wasnt a real company. Apparently there is a real company. Apparently that company thinks the truth is defamatory. Well.. the truth isnt false. Thats the problem. There is NOTHING FALSE about my writeing in the RIP OFF report that this woman WOULD NOT STOP emailing me after I told her to quit. It took for me to get on this rip off report and write about her actions before she would quit spamming me. Suddenly she is sending a letter from her lawyer? This is beyond stupid. Why didnt the woman simply quit sending messages and text messages after REPEATEDLY telling her to quit?
