i suffered a massive stroke on march '06. it left me a diabetic, partly paralysed, with severe speech problems and the list goes on. i owed money on a student loan and two credits cards. both credit cards totalled less than $1000 dollars. one was forgiven. the other, was not. the loan was forgiven, too. a $500 debt went on to about $1200 dollars before love, beal and nixon became the 2nd collector to take over. i managed to contact the 1st collector and tell them my situation by email. they sent my case back to the credit card company. i have been unable to work. i don't know when i'll be able to. i don't dispute that i owe, but my circumstances merit some leniency. i received a summons from love, beal and nixon last month. a friend called them explaning my situation. their reply was that they understood but, they already paid for my debt. i even contacted them by mail explaining my situation. all they said was that if i received a stimulus check, they would settle the debt. as far as i know, i don't qualify for a check. i suppose they'll get a judgement in their favor but, like i said before, there are circumstances that make me unable to pay. they are suing for about $1500 dollars. i make no money.

Right now my husband and I are fighting the same group. But if you are disabled and are getting SSI then I would would call Legal Aid in Norman. If you are disabled and don't make any money but disability, they will help you. If the collection agency sent it to Arbitration already then they will help you right away. You are disabled and make under the poverty level so I am positive they will help you. Just in case you don't have the number here is their 800 number. 800-421-4057

First, call 1-800-tax-1040 and ask if you qualify for a rebate. If you do hopefully LBN will honor there verbel agreement and take it.
Second, LBN will get a judgement against you and then they will go like a mad dog and try to get there money. First they will try to garnish your paycheck, the good news is they cant garnish ss payments. Next, they will send a bank a garnishment that basicaly will take all your money out of your bank account and if you have any checks you wrote they will bounce. The good news is if you can prove to the court that all the money in your bank acount was from SS then they (I believe) have to return it. Third, if you own a house or car they can put a lien on it which doesnt mean much until you go to sell it. (usually LBN goes after the house not the car)
If this is your only debt then banqruptcy doesnt make any sense so your only choice is pay them or if your judgement proof(meaning you dont own squat in your name, no bank account and only draw ss or some other excempt check) then dont pay them.
Remember if your not judgement proof the longer time goes by the higher you will owe so now is the time to try to settle.
