I contacted LVNV Funding by filing a complaint with the Department of Financial Institutions of Wisconsin. I requested copies of all transaction slips with the fraudulent signatures, and any other documentation.

The first letter I received is they would respond within 12 weeks. I filed another complaint. This time they claimed they do not have to validate the debt. They cited a few cases.

I am at a standstill. I will fight them. I am concerned about default judgements and liens. I check the clerk of courts website regularly to avoid these deadbeats not serving me properly.

I have filed numerous complaints against them with FTC.

As for lawyers, I can not get any straight answers on whether they what debt validation entails etc. I will probably be pro se.

They have reaged the debt and I have filed disputes with credit bureau's. They were validated thru the credit reporting agencies.

The fraudulent debt is most likely date back to 2002. The wisconsin department of financial instutitions has been helpful however, The coachroach mobsters persist in listing it on my credit report.

Steve, or anyone else with information on sample documents to answer a complaint, filing for discovery and interrgotaries. Anyone having samples I would appreciate it. I can adapt it to Wisconsin. I am preparing for the day I have to fight them in court. I will respond with a demand for jury trial. I dare them to prove the debt based on lies to a jury. The debt is the result of fraudulent charges after it was paid off. I moved and was unaware of this till recently.

Nothing been filed against me in Wisconsin court system.

Hi,
I have been sued by one of these companies
I believe all are owned by Encore
I got information on here and it was so
helpful as I didn't know where to start but "J" I believed advised me to get a
lawyer if possible. I had not had much luck with the ones I had talked to as
they didn't seem to know as much about consumer law as I did after much research.

I did it pro ce but after checking on Bud Hibbs site (after no respond to request or discovery) and corresponding with him I
was put in touch with a lawyer that took my case with no cost to me. My lawyer
tried to admend my response to summons and my denial but the company refuses to allow
it..so now I can't change some things that could really matter like the fact they are not licenced in my state.

Mine was a fruadulent case but they have
information that seems to link it to me but cannot have papers to back it up....
I think they are willing to drop the suit
now but I have to decide if I want any
compensation for all I have went through.

Just my advice to cover all bases
and a good consumers lawyer sure can't hurt.
