I requested validation of a debt through this company in May of 2007, account management was then forwarded to Weltman, Weinberg, and Reis. I requested validation through them, still haven't heard anything back from them. Additionally they have committed several FCRA violations:
Equifax;
Account type listed as open, should be collection
Date of last payment: 3/06, I have never made a payment to them, amount of last payment is $0.00, just trying to extend the SOL
Type of loan: Factoring company account, they are not a factoring company, it should be collection.
Comments: Consumer disputes this account information (I never disputed this with any credit reporting agency (yet)

Experian;
Reporting recent payment of $0.00
Listed as a installment loan, should be collection.
Account information disputed by consumer (meets requirement of the FCRA) I never filed a dispute (yet)

Transunion;
Account type: open account. Should be collection
Date opened 4/05, it has been reaged
Listed as factoring company account, it is a collection account.

So far that's two FDCPA violations and eight FCRA violations.

Do have proof of reaging.....Then Hire a NACA lawyer

my understanding is that reaging is a violation of federal law. If you can prove reaging based on complete copies of your credit report. I would goto NACA. Some NACA lawyers will take the case on a contingency basis. I found that my NACA attorney cares about people. So try it, it may work out for you.

If you choose not to do this. File a complaint with the South Carolina Attorney General's Office. Provide the proof of reaging. Ask them to provide only info pertinent to your complaint from your credit report to LVNV Funding. Black out your personal information (except your name). I would also demand debt validation in your complaint.

The Federal Trade commission will take your complaint at: WWW.FTC.gov . The more complaints the more likely they will sue them. Please do this.

good luck and remember never talk with with a dirt bag from this LVNV Funding. Never.....ever admit owing the money or provide bank account numbers. Tape them if they threaten you. Hire a NACA lawyer. They stop them in their tracks.
DO NOT SEND THEM MONEY. THAT RESETS THE STATUTE OF LIMITATIONS.
