I have been trying for months to correct my credit report only to be told that everything has been validated and will remain on my credit. I was just trying to refinance my home and told that my credit score was too low mainly due to LVNV FUNDING. They have reported the same debt on my report three times and also on my husbands report 3 times. The same amount is listed so it looks like we owe 3 times the balance they claim. They also list past due amounts which I was told is against federal law to list charge offs and past due amounts.

LVNV FUNDING have their address listed as P.O. Box 10584, Greenville SC 29603 on one of their accounts, P.O. Box 740281, Houston, TX 77274 for one and the same SC address with their name listed as LVNVFUNDG on the other. I am told that they will not validate nor remove this as it is accurate.

Is their anything that can be done about this - I know it is not right but don't know how to get it corrected with all the red tape.

Lola,

Although I have never delt with LVNV,I have personally delt with many creditors trying to fix my own credit. I can tell you this. They do not care about you or the fact that the information that they reported is false or inaccurate.

I have, and you can too, pull your credit reports from Equifax, Transunion and Experian.(E,T,E) And you can dispute these lies. -- But really in the end; it is futile.

E,T,E will call LVNV to ask if this is correct and they will say it is. E,T,E will never ask for or demand documentation to back up what is in dispute. A simple "yes" is all that is needed for them to say that they have investigated the issue.

I am not saying that E,T,E has never fixed things on my credit that were inaccuate. They have. But when it comes down to a creditor that you have called and repeatedly asked to fix bad info. and you get nowhere --- Do you think that they will change their tune when E,T,E calls them? No Way!

Lola, What you need to do is get an attorney. That really is the ONLY way that LVNV will back off and fix it.

This is easy to fix, and you are entitled to damages under both state and federal laws.

First, Stay off the phone altogether. Any correspondence to ANYONE needs to be by certified mail, return reciept requested. Put the certified# on the letter itself, and keep a copy for your records.

Immediately send disputes to all credit bureaus involved. Specify that you want to excercise your rights under the FCRA and recieve copies of all communications used in this alleged "validation". They must provide full names, addresses, and phone#'s of all parties contacted, and copies of any written communications sent and/or recieved.
DEMAND this. It is your legal right.

File FTC complaints at FTC.gov against the collection agencies involved as well as the credit bureaus. Do this online. And do an individual complaint on each violation. This is very important, as enforcement is not done on an individual basis. it is done after a certain # of complaints have been filed.

Send your notice of each violation to all collection agencies involved, and demand it be corrected. Reference your FTC.complaints.

Unfortunately, you must sue to recover damages from a collection agency, and they know most consumers won't. That is why they keep violating.

Read and print out both the FCRA and the FDCPA. get very familiar with your rights.
