Company puts derogatory info on credit report after account has been closed for years. Bought closed account and is attempting to collect on account. SOL has been violated. Not only has original account on my credit report but puts their account on as well. Now i have 2 of the same entries from 1996 wreaking havoc on my report.
One credit agency has disputed it and says all is ok. What a joke and i get no say so. I figured since 1996 i wouldnt need to keep documents from 11 years ago. Im fuming!!!!!

Mark,

First of all, keep in mind that you never have to prove that you do not owe a debt, they always must prove that you do.

You need to send LVNV a DEBT VALIDATION request. In this request clearly deny the debt and demand to see the original signed contract that created the debt. Also demand a full account history and itemization of charges. Finally, demand proof that they own the debt which must include the purchase contract and proof of payment.

Also demand that all entries on your credit report be removed immediately until such proof is provided.

Send this to them by certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records. This is very important as it proves exactly what you sent.

Now, by the same means above, send your dispute to the credit bureaus involved. In this dispute, simply state that you never had a business relationship of any kind with LVNV and this entry MUST be removed immediately. Specify that you are exercising your rights under the FCRA to recieve copies of all communications used in the investigation of your dispute.

You are entitled to punitive damages of up to $1000 per violation under the FCRA and also can recover actual damages.
