Was hired to do a very simple job. Mansfield Nix over-promised and through gross negligence failed to deliver. Due to money mismanagement and overdue accounts at construction equipment rentals, he had to be paid upfront to gain access to machinery needed for the job. Mansfield failed repeatedly (4 times) to show up at the job site, and at times that he did was hours late to arrive. Mansfield's crew consisted of 1 seasoned worker, a barely legal teen, and newly hired guy 1st day on the job. Not 1 of the 3 received guidance on what they were there to do. Mansfield was of course not there and went off to do something apperently more important. Long story short. Job not finished. Deposit stolen.

Box 1826 Tavares, FL 32778 Tel: (352) 630-8481 Fax:(866) 584-0425 Email: LPCESQ@cfl.rr.com : Petr Vach Complaint Against Mansfield Nix and Mansfield Nix Seal Coating and Paving Dear sir or Madam: Please be advised that the undersigned represents Mansfield Nix and Mansfield Nix Seal Coating and Paving. Mr. Nix and I have reviewed the allegations of Mr. Vach and rest assured that Mr. Nix will be taking all necessary actions against Mr. Vach. Mr. Vach has not only filed this complaint with the BBB; he has also filed a small claims action in Lake County Small Claims Court as well as made many disparaging and inaccurate comments about him through-out social media. We are currently preparing to respond to the Small Claims action and therefore cannot disclose any evidence to you at this time which may make its way to Mr. Vach prior to him making an appropriate and procedurally correct request for same.

The matter is simply this. Mr. Nix' company was retained by Amerigas to install a concrete slab on Mr. Vach's property for the purpose of the installation of a propane tank. I am able to and have enclosed a copy of said contract. Mr. Vach, who was to benefit from the installation of the propane tank wanted the work to commence as soon as possible. Mr. Nix explained that it could not commence until the permits were obtained, at which time Amerigas, pursuant to the contract, would provide $2,500.00 as a down payment on the total bill of $4,050.00. Mr. Vach, who owned the property, convinced Mr. Nix to at least commence the initial work of excavating the site and installing the necessary forms. Mr. Nix explained to Mr. Vach the necessity of needing the upfront money to be able to rent the needed heavy equipment and pay the crew. Mr. Vach agreed to lay out $1,500.00 of the needed funds so the preliminary work could begin while the permit was being processed. The $1,500.00 was to be repaid from the $2,500.00 deposit that Mr. Nix was scheduled to receive from Amerigas upon the approval of the permits. awrence P. Cartelli BBB of Central Florida Case Number 90188586: Petr Vach March 30, 3017 Page 2 Mr. Nix and his crew appeared at the job site the first morning but had to wait until the end of the day for payment.

Mr. Vach presented Mr. Nix a check drawn on a company owned by Mr Vach and Mr. Nix needed to deposit the check and allow it to clear in order to insure there were available funds to commence the work. It took three (3) days to clear his bank. Once the check cleared, Mr. Nix returned to the job site to find that Mr. Vach had tried to do the work himself but the job was so poorly done, Mr. Vach's work had to be ripped out before Mr. Nix' crew could re-start the work. Much of the work had been completed when Amerigas informed Mr. Nix that the permits were ready. He advised Mr. Vach of the approval of the permits; however, Mr. Vach would not allow Mr. Nix back on the property. Mr. Nix informed Amerigas who contacted Mr. Vach and tried to resolve the situation; however, he continued to refuse. Mr. Nix could not commence his contract with Amerigas which would have provided him immediately with the $2500.00 deposit from which Mr. Vach would have been repaid the monies he advanced. Mr. Nix and his crew had to re-do all of the work that Mr. Vach had taken on himself and then completed most of the preliminary work. The monies paid by Mr. Vach were actually expended to complete the work performed by Mr. Nix. Had Mr. Vach allowed Mr. Nix back on his property after the approval of the permits, he would have received the return of his money thereafter.

Inasmuch as it was agreed that the $1,500.00 was to be repaid from the monies received from Amerigas and that work had been completed; Mr. Vach's denial of permission for Mr. Nix to enter his property was the direct cause of his failure to recover his money. Mr. Nix will vigorously defend the small claims action after which I have been directed to commence an action against Mr. Vach for libelous and slanderous statements against Mr. Nix and his company.  Mansfield Nix is a small company that thrives to please all there customers some people you will never be able to please no matter how much work and effort you put into their jobs, but instead they want to sabotage a man that probably did all he can do to help them. I guaranteed you did not pay Mansfield Nix all his money I never seen him walk away from a job, and he does great work he's done plenty of work for us never had a problem with him running off. And I'm talking about thousands of dollars never once did he showed us that he was not trust worthy!! Marie
