I worked at maxwell preschool academy for two days. In the folders with all the information to sign is a two week contract. I didnt sign it but they still wont give me my check. The reson i didn't sign it is because of two reasons one the handbook say arizona is a at will state and i can quit when i wont with out notice but then they want me to sign a contract saying that i have to give a two week notice and work the whole two weeks or they will keep my check. The second is because you never know what will happen and if i quit i didnt want them to keep my check but they did anyway.

The reason i quit is because what they said before i started was different from what they did when i started. First they made it seem like they are all about education but when i started it was a fake. All the kids seemed sick. They told the parent that they were teaching the kids but weren't. Half the toys were not working and it was only about 4 books in each room and those books were toren apart. Also i just didn't want my kids going to daycare that didn't care about the kids they educate.

i dont think this is legal and dont know what to do. i am a single mother of two and going to school full time and they are keeping my 100$ check. I need that money. It dont seem like a lot but it is to me.

The "contract" they try and get you to sign is not legal. Even if you had signed it, they are not legally allowed to with hold your paycheck. In fact, by law, the employer has 72 hours to release your check to you personally, or by certified mail from the time you give written notice, or verbal. I would highly recommend that you document the time and your hourly wage, and either walk in to the labor board, or file a complaint online if that is available to you. Even if you did not preform to the companies standards for the 2 days you worked, they still must pay you for your time.
