MeasureComp ripped me off to. Quit and filed for Unemployment Benefits; I knew I quit w/Just Cause. Fought for Unemployment Benefits, Turned over to Industrial Commission for hearing. Hired an attorney for last hearing, MeasureComp didn't even show up. I lost, I feel as if I proved my case, with documents of pay changes, not getting paid for extra measures, How they now subtracted my miles from my base pay, making less money and my driving route was now 3-times longer. After 2-years recieved the following letter; "As you all know,MeasureComp pays its employees on a piece rate basis, a handful of employees may have worked some overtime hours. A question was raised regarding whether time spent in the morning downloading customer lists, calling customers, and planning routes is compensable. The company, recognizing this potential, has reviewed its records and would like to pay our employees for these potential overtime hours to express our appreciation for your service during the last three years, and to insure our compliance with the overtime laws set forth in the FLSA. Therefore, enclosed please find a MeasureComp check to you, in recognition of potential overtime hours worked. Thank you for all that you've done for MeasureComp. Very truly yours, MEASURECOMP L.L.C.
My check is for $750.00 before taxes
Still showing on check stub is 14.2 hours of vacation pay earned, never received last vacation pay same as last check over 2 years ago.
I also told Industrial Commission @ hearing that I worked 10-12 hours a day for almost 2-years.
My question is do I cash check? need the money, but amount is way too little too late.
Any sugestions would be much appreciated!

#2UPDATE EX-employee responds

Fri, May 16, 2008

In Oct of 2007 I filed a lawsuit against MeasureComp in Akron Federal court alleging that MeasureComp violated federal wage and hour laws for failing to pay over time to current and former techs who had worked in excess of 40 hours per week.My lawsuit was filed as a collective action meaning that other techs would be able to join the lawsuit.

It is my understand that in response to my lawsuit MeasureComp has recently begun to issue checks to current and former techs in Ohio for unpaid overtime. If you recieved a check you may be intitled to more overtime pay from MeasureComp.

If you are interested in joining this lawsuit or have information that will be helpful in proving MeasureComps failure to pay overtime please contact ripoff who I give permission to release my personal information to any tech that would like information.
