Mel Clayton Ford lied to me about their contract. I had recently purchased a 2005 Ford Escape, however 2 days later my financing fell through. I talked to their financing department about bringing back the car, per the contract and they claimed that I was in default of the contract. I asked to talk to the Sales Manager, a person by the name of John Loviteer. He said, on the phone that I could bring back the vehicle and get my trade-in vehicle back, however when I showed up at the dealership, he changed his story. He claimed that he had 30 days to obtain financing, per the Arizona Revised Statues.

When I asked where that information was in the contract that I had signed he admitted that it wasn't in there, however it was an AZ Law. Well, I wasn't going to take his word for it, so my grandfather pursued this with the Attorney General's office. After reviewing the contract, they said that there was no evidence of the 30 days for financing and told him to immediately contact his lawyer. Why? Because there was some fraudulent stuff going on.

My grandfather and I went to the dealership to return the car and get my vehicle back, but they only agreed to do so when my grandfather said that he was a journalist and was going to leak this to the press and we would take legal action. They did not want this to happen so they agreed to recind the contract. I then signed a paper that stated that the contract was recinded due to the fact that I could not obtain financing.

However, when the loan officer told a valet to get my car from their "bullpen", he could not locate it. They had already sent it off, without the title no less, to an auction house. Now I ask...how can they legal do this? How do these people get away with all the lies and deceit? I will make sure that I let it be known that they will not get away with this...no matter who I have to contact.

Mel Clayton Ford will pay and they will not be able to take advantage of anyone else. If you are thinking of purchasing a car at Mel Clayton Ford or anywhere else, just remember that if the dealer says something that is not in the contract, you are not bound by that. You don't have to sign more than one contract if you don't want to. Please learn from my experience.

Desiraesounds to me that you did this car buyer a bit good making sure that she got her trade back and her down payment back. As a Consumer Advocate and supporter of Ripoffreport.com I thank you.

My only problem is that she was put in a "Spot Delivery" You and I both know that should never happen to car buyers. Many car dealers love using the "Spot Delivery" process. It helps keep control of up's until the car buyer's credit report has been sent to God only knows how many lenders.

If you are in charge of CSI you might want to have a chat with your F&I people and explain that "Spot Deliveries" are not good for your CSI numbers. Yes, I know that many car dealers don't want their Up's to not be on some kind of chain that can be yanked.

Also If you don't believe me, Contact William Clay Ford, who is the President of Ford Motor Corp. and ask him how he wants Ford's CSI program to take place. His Email is Wford@ford.com

Why would John Loviteer Tell Lauren that he had 30 days to obtain financing, per the Arizona Revised Statues? Can you imagine what could happen to a car Buyer's credit report in 30 days if she was in a "Spot Delivery"?

I would think that GM's in the auto industry would have the ability to hire F&I people that had a good idea what was needed to hang paper with lenders. Should not take 30 days!

Ask John Loviteer to do us all a big favor and post that AZ Revised Statue. I am sure that he will not because it does not exist!

You said that your grandfather was a journalist and was going to leak this to the press! Trust me on this.

No newspaper, No TV station or Local Talk Radio station will ever expose Car dealer Rip Off's. I am a car buyer's Advocate and some say I have a big mouth and I have never been able to find a form of media that will let me expose the auto industry. This web site is the only place that will let insiders tell all!

I figure that the AZ Republic gets maybe some where close to $1,400,000 per month, That's 1.4 Million in new car dealer advertisement revenue money. Trust me they will never bite the big hands that feed them. If you want to put the local media to the test, try this.

Email the following people at 550 KFYI and ask them why it sure seems to Stick that they will never let callers chat LIVE on their talk show and expose new car dealer Rip offs.

Ask these Microphone Mutts if they will have a day only devoted to callers that are willing to tell all of their car buying horror stories! Post their replys on this Report. I would love to read them.

Trust me they will not chat "Live on the AIR" about car dealer Rip Offs and scams! They say their station is a "TALK RADIO" Station. So let us talk!

Microphone Mutts will never expose the auto industry. They will say some crap like, It's boring or no body wants to talk about car buying scams.

Car buyers are not informed of car dealer Rip Offs or scams because it sure seems to me that advertising money is much more important then informing consumers of Rip Offs.

By the way Lauren Thanks for taking the time to file a Rip Off Report. It helps others learn what can happen when buying a car.

Mrs. Allen signed a Pruchase Rescission Agreement wherein Mrs. Allen acknowledges her trade-in was returned to her along with her down payment of $750. In addition, I took Mrs. Allen to QT to fill her tank with gas and fill her tires with air(she felt her car was acting funny). She also had an appointment with Arizona Outfitters to have her stereo replaced because the faceplate was missing from her vehicle.
I have since spoke to Mrs. Allen to be certain she is satisfied with our resolution to her concerns. She assured me that she is completely satisfied with us.
