RE: Scum bag steals money from police department sponsored children's center program.

After a six months of collecting donations to purchase a hearing testing machine I purchased an audiometer on ebay for our local children's center. The seller, represented the unit as "barely used" and in "good working order."

When the unit arrived via mail, two parts fell out of the machine and it did not work. Jim Fry said to return the unit for a full refund. I did, and then he refused to provide a refund. He said to provide the return US Mail insurance info which I did.

Now, he is refusing to refund the money form the insurance, which is nothing less than mail fraud. Moreover, I am confident he will try to sell the returned broken product as well as other garbage to others.

Do not be fooled. In 20 years of public service, I have yet to see a bigger con artist or scamster.

Here is what Jim Fry of MEM(CO) said about the unit:

"I'm sorry I was a little unclear. The unit is a TM 262 equiped with head phones and audiometry. This unit was used very very little in a Chiropractor/ MD's office for 3 years. I am a Biomedical Technician and verifiy that the unit is function on myself."

When the audiometer showed up on my doorstep it was broke and I wrote:

"The audiometer arrived today. When I lifted out of box, two small black parts fell from within the device. There is still a part rattling around on the inside connected by a wire. There are no tips to the pneumo wand, nor is there any paper in the device so I do not know how you could have possibly tested the wand or the printer function to say the unit is in good working order.There is a clear scratch on the surface of the LCD screen. The pneumo handle has a constant varying error orange color display. There is no change to green or any indication that the the tymp or reflex component of the device is actually in working order.

When you indicated that this machine was used very little, I took that as the thing actually works and is complete with the parts to make this work. I am asking that you either refund my prompt return on this merchandise.

Please let me know your intentions."



Then, he promised a full refund, which later he reneged:

"Please return it to us for a full refund providing it is in the same condition as to when it left here. There was nothing in the box and the unit was intact. Use a tracking #. "

"So I sent back to him, after insuring. After a few weeks of waiting I wrote, wondering about the refund:

Please let me know date and how refund will be provided. I'm trying to be patient, but we are now going on close to 30 days since I made my payment. In light of the fact I received a non-working and incomplete unit that was represented in good order and ready to go, my patience is dwindling fast.

As with any con and scam game, this is when the lies started to occur:

You need to need patient. You should have told me the unit arrived damaged from shipping. The unit was in good working order!!! The descrition didn't say anything about the disposibles being included which wouldn't have made a difference anyway since the unit arrived to you damaged. I'll be in contact with you Monday afternoon our time."

OK, at this time I was still giving this scam artist the benefit of the doubt:

"Again, you and I are having communication difficulties.

You represented this unit as barely used. You stated you checked this unit on yourself and it was functioning properly. The unit arrived in non working order with parts coming out and a rattle and the the wand was without pieces and there was no paper in the unit. This questions the veracity of your initial statements. Nonetheless, perhaps you placed paper in the machine, tested it and then took the paper out. Perhaps you added the ear tips and then took them back after you tested on yourself. I do not know.

I do know however that if a refund of $1250.00 plus $31.12 for shipping this junk back to you for a total of $1281.12 is not provided by 5:00 pm pacific time, I will start the recourse process with both ebay and paypal to recover my funds."


This was part two of his scam: to get the mail insurance money from the post office on top of the money he had already scammed from me:

"I talked to the Selinsgrove, Pa Post Master and since it is insured he said he would have no problem reimbusting us for it if the insurance amount.
The post manster will need a photo copy of the receipt that you paid for the insurance. We already gave hime the tracking number of the box.
If you will cooperate in this matter I will refund your money asap."


Another mistake I made: I still trusted this con artist to believe that he would provide a refund:

"I just faxed over the receipt. Please note that on my end it was only insured for a thousand dollars. I will need the entire balance refunded."


After no response and figuring this guy was nothing but a scum bag and con artist, I placed negative feedback on ebay and again requested a refund. His reply:

"If you remove the negative feedback we will refund you today via Paypal and end this mess."

This is my absolute favorite email I got from this scum bag. Apparently, he kept this going until he could also get the money from the mail insurance policy in which I paid to have the thing returned:

"I never used the word promise to you sir. Remember we are waiting on the results from the post office insurance which I should hear something today or tomorrow."

I again reminded this dirt bag he was stealing money from donations for a children's center,

Jim fry replied:

"Thats right its all about you lucky boy! I did this just to cause you grief. You might want to look up Narcisistic personality disorder and then go for help. Your unreasonbleness in this matter has me dragging my feet. I see you are new to Ebay and that you don't know the rules. You haved called me names again. Now you want to threaten me with Ebay. I'm sure you will get your money back, but not until Paypal pulls it from my account. Next time remember that "I matter you matter" is the golden rule in life. Its not I matter you don't and you matter and I don't. Please do not bother to respond. Furthermore, it doesn't apprear that you are doing the police department much of a service by acting so unprofessionally. You might be educated, but you need to learn some respect.
