The Q Sportsclub in Austin, TX has an extremely unfair membership dues policy. Due to a business relationship, I received a special membership at The Q. It was for 1 year. I could not terminate my membership during this time and could only transfer my membership to another employee in my company. However, I lost my job 3 months into my membership with The Q.

I was leaving the Austin area and due to the nature of my employment termination, I was unable to transfer my membership to another employee. My membership was $398.00. Being unemployed, I needed the remainder of my membership back to pay living expenses. I spoke with David Devine at The Q Austin who advised me to submit a copy of my termination agreement (which was confidential) with a letter of explanation requesting for a refund of my remaining membership.

I received no response to my written request, so I contacted Art Vega with The Q's corporate headquarters who exercised stall tactics for 1 month advising they had no record of my membership--even though my check had been cashed.

In the end, I asked to speak with The Q's corporate counsel. I received no response to that request. Finally, Mr. Vega verbally advised me they would not be refunding my money.

I feel that this was extremely unfair. first, i was not given a written response to my qualified written request for information. second, how could mr. vega state they had no record of my membership when my dues had been paid & my check cashed? third, why was no special consideration given to my case as i was assured by Mr. Devine it would be?
